RESOLUTION 1) APPROVING THE ENGINEER’S REPORT; 2) SETTING A PUBLIC HEARING TO CONSIDER ANY AND ALL OBJECTIONS TO THE FORMATION OF SAID ASSESSMENT DISTRICT AND THE LEVYING OF ASSESSMENTS; AND
3) DIRECTING THE DIRECTOR OF PUBLIC WORKS TO SEND TO ALL PROPERTY OWNERS WITHIN THE PROPOSED DISTRICT AT LEAST FORTY-FIVE (45) DAYS PRIOR THE PUBLIC HEARING, A NOTICE OF THE TIME AND DATE OF SAID PUBLIC HEARING AS PROVIDED BY APPLICABLE LAW, AND A BALLOT AS PROVIDED BY APPLICABLE LAW, WHICH BALLOT MAY BE USED BY THE PROPERTY OWNERS TO INDICATE THEIR SUPPORT OR OPPOSITION TO BEING ASSESSED THE COST OF CONSTRUCTING SAID IMPROVEMENTS.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on October 30, 2007 the Board adopted Resolution No. 069071, authorizing the Department of Public Works to proceed with preparations for the construction of slope stabilization improvements (the “Improvements”) at the earliest opportunity during the next construction season, and continue to communicate and work with the La Honda community to identify cooperative funding arrangements and other potential funding sources; and

 

WHEREAS, pursuant to the resolution of this Board, in connection with the Improvements the Director of Public Works has prepared a report and filed that report with the clerk of this Board (the “Engineer’s Report); and

 

WHEREAS, the Board must comply with the applicable notice, protest and hearing requirements imposed by law, including Streets & Highway Code Section 10300 et seq., Government Code Section 53750 et. seq. (Proposition 218 Implementation Act) and Article XIIID of the State Constitution.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors of the County of San Mateo, State of California:

 

1.

Approves the Engineer’s Report;

 

2.

Declares its intent to form an assessment district and to assess the parcels within the proposed district for the cost of constructing soil stability improvements within the Scenic Drive landslide in the La Honda area.

 

3.

Sets Tuesday, the 22nd day of April 2008, at the hour of 9:00 a.m., in the Chambers of the Board of Supervisors of the County of San Mateo, in the Hall of Justice and Records, 400 County Center (formerly 401 Marshall Street), Redwood City, California, as the date, time and place for a public hearing to consider any and all objections to the formation of said assessment district and the levying of assessments.

   

4.

Directs the Director of Public Works to send to all property owners within the proposed district at least forty-five (45) days prior the public hearing:

 
 

a)

a notice of the time and date of said public hearing as provided by applicable law; and

 
 

b)

a ballot as provided by applicable law, which ballot may be used by the property owners to indicate their support or opposition to being assessed the cost of constructing said improvements.
