RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO APPLY FOR TRANSPORTATION DEVELOPMENT ACT (TDA) FUNDING FOR PEDESTRIAN SIDEWALK ACCESS RAMPS AT VARIOUS LOCATIONS IN SAN MATEO COUNTY UNDER THE CITY/COUNTY ASSOCIATION OF GOVERNMENTS (C/CAG) GUIDELINES FOR CITY/COUNTY ASSOCIATION OF GOVERNMENTS (C/CAG) BICYCLE AND PEDESTRIAN PROGRAM TDA ARTICLE 3 APPLICATION FISCAL YEAR 2008-2009

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the Director of Public Works has recommended that the County submit an application for Transportation Development Act Funding to partially finance the installation of pedestrian sidewalk access ramps at various locations in San Mateo County for 2008-09; and

 

WHEREAS, Article 3 of the Transportation Development Act (TDA), Public Utilities Code (PUC) Section 99200 et seq., authorizes the submission of claims to a regional transportation planning agency for the funding of projects exclusively for the benefit and/or use of pedestrians and bicyclists; and

 

WHEREAS, the Metropolitan Transportation Commission (MTC), as the regional transportation planning agency for the San Francisco Bay region, has adopted MTC Resolution No. 875, Revised, entitled “Transportation Development Act, Article 3, Pedestrian/Bicycle Projects,” which delineates procedures and criteria for submission of requests for the allocation of “TDA Article 3” funding; and

 

WHEREAS, MTC Resolution No. 875, Revised, requires that request for the allocation of TDA Article 3 funding be submitted as part of a single, countywide coordinated claim from each county in the San Francisco Bay region; and

 

WHEREAS, the County of San Mateo desires to submit a request to MTC for the allocation of TDA Article 3 funds to support the projects described in Attachment B to this resolution, which are for the exclusive benefit and/or use of pedestrians and/or bicyclists; and

 

WHEREAS, this Board has considered the recommendation of the Director of Public Works.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

 

A.

The Director of Public Works is authorized to execute and file an application, for funding under the Transportation Development Act Funding for Pedestrian Sidewalk Access Ramps at Various Locations in San Mateo County 2008-09 to help finance the cost of installing ramps. The Director of Public Works, upon making the appropriate determinations, is authorized to attest to the accuracy of, and make the findings listed in, Attachment A.

 

B.

This Board will provide $10,000 in non-federal matching funds for the project.

 

C.

This Board is aware the Transportation Development Act Funding for the project is fixed at $100,000, and that any cost increases must be funded by the County from local matching funds, and this Board does not expect any cost increases to be funded with Transportation Development Act Funding.

 

D.

The County of San Mateo declares it is eligible to request an allocation of TDA Article 3 funds pursuant to Section 99234 of the Public Utilities Code.

 

E.

To the best of this Board’s knowledge there is no pending or threatened litigation that might adversely affect the project or projects described in Attachment B to this resolution, or that might impair the ability of the County of San Mateo to carry out the project.

 

F.

That a certified copy of this resolution and its attachments, and any accompanying supporting materials, shall be forwarded to the Congestion Management Agency, Countywide Transportation Planning Agency, or City/County Association of Governments (C/CAG), as the case may be, of County of San Mateo for submission to MTC as part of the countywide coordinated TDA Article 3 claim.
