County Manager's Report #2—Resolution to amend the 2007-2008 Legislative Session Program

 

RECOMMENDATION:

Adopt a resolution amending the 2007-2008 Legislative Session Program

BACKGROUND:

The 2007-2008 Legislative Session Program (Legislative Program) articulates San Mateo County’s goals and objectives as they relate to the 2007-2008 legislative session. The proposals, priorities and policies in combination with other positions adopted by the Board of Supervisors guide the County’s legislative advocacy efforts. The Legislative Committee in coordination with County staff, departments and the County’s advocates developed the Legislative Program.

 

At the close of the first year of the session, County staff revises the Legislative Program in response to the activities of the first half of the session. Changes to the Legislative Program reflect resolution of legislative proposals and shifts in priorities and policies.

 
 
 

DISCUSSION:

While the Legislative Program attempts to cover the breadth and depth of legislative issues that may have an impact on San Mateo County, it is not comprehensive, complete or final. However, the mid-session amendments to the Legislative Program attempt to reflect the new and changed issues that are likely to have an impact on County services and operations. Some of the notable changes to the legislative program priorities section include the elimination of:

 

    § San Mateo County Demonstration for Orders to Seek Employment for Non-Delinquent Child Support Obligors—SB 523 (Yee) Child support: order to seek employment. 09/26/2007: Chaptered by the Secretary of State, Chapter Number 249, Statutes of 2007

 

The inclusion of:

    § Proposition 1B Transportation Bond Fund language outlining the County’s efforts to work with the State to advance the schedule for the release of Proposition 1B Transportation Bond funds to make up anticipated Proposition 42 revenue suspension to the County.

 

Staff recommends that efforts on the following list of proposals continue from 2007 with no amendments:

    § Next-of-Kin “Right to Know”—A law that would require coroners to notify, in a timely manner, known next of kin that the coroner may retains parts of a body. This proposal would also require that the coroner offer to return the parts of the body. This proposal would exempt notification if it would interfere with a criminal investigation.

    § County Recording Fees—Allows any county to increase real estate document recording fees to fund affordable housing development.

 

As in the past, protecting County funding and operations will remain a top Legislative Program priority.

 

The Legislative Committee has reviewed the proposed amendments to the Legislative Program and recommends approval by the Board of Supervisors.
