RESOLUTION AUTHORIZING THE DIRECTOR OF PARKS AND RECREATION TO SUBMIT AN APPLICATION TO THE UNITED STATES FISH AND WILDLIFE SERVICES (USFWS) TO AMEND SECTION 10(A) PERMIT PRT 2-9818 TO INCLUDE THE CALLIPPE SILVERSPOT BUTTERFLY AND BAY CHECKERSPOT BUTTERFLY AS LISTED SPECIES

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, in November 1982, the County approved the San Bruno Mountain Area Habitat Conservation Plan (HCP), as a vehicle to reconcile development interests on San Bruno Mountain with the protection and enhancement of the ecological values on the Mountain; and

WHEREAS, in March 1983, the United States Fish and Wildlife Service (USFWS) issued Section 10(a) Permit PRT 2-9818 to allow the incidental taking of certain species protected under the Endangered Species Act, including the mission blue and San Bruno elfin butterflies, in conjunction with development activities allowed under the HCP; and

WHEREAS, the HCP was developed with the assumption that the callippe silverspot butterfly and Bay checkerspot butterfly would be listed for protection under the Endangered Species Act; and

WHEREAS, because the callippe silverspot and Bay checkerspot were not listed, they were not included on the Section 10(a) Permit; and

WHEREAS, in 1983, the USFWS listed the Bay checkerspot as an endangered species, and in December 1997, the USFWS listed the callippe silverspot as an endangered species; and

WHEREAS, this Board now desires to make application to have the callippe silverspot and Bay checkerspot listed on Section 10(a) Permit PRT 2-9818, so that they will be treated in like manner as the other listed species and in the manner contemplated when the HCP was formulated;

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Director of Parks and Recreation is hereby authorized and directed to forward to the USFWS an application to amend Section 10(a) Permit PRT 2-9818 to add the callippe silverspot butterfly and Bay checkerspot butterfly as listed species, and is further authorized and directed to prepare, execute and forward to the USFWS any other documentation that may be required to process this application.
