RESOLUTION 1) DECLARING THE INTENTION TO ORDER THE CONSTRUCTION OF SOIL STABILITY IMPROVEMENTS WITHIN THE SCENIC DRIVE LANDSLIDE IN THE LA HONDA AREA AND TO FORM AN ASSESSMENT DISTRICT TO ASSIST IN THE FINANCING OF THAT CONSTRUCTION; AND 2) AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO PREPARE AN ENGINEER’S REPORT, MEETING THE REQUIREMENTS OF SECTION 10204, OF THE STREET AND HIGHWAYS CODE, FOR THE PROPOSED ASSESSMENT DISTRICT.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, this Board of Supervisors did, on October 30, 2007, adopt Resolution No. 069071, authorizing among other actions, that the Department of Public Works proceed with preparations for the construction of recommended slope stabilization improvements (the “Improvements”) such that the work could begin at the earliest opportunity during the next construction season, and continue to communicate and work with the La Honda community in the consideration of cooperative funding arrangements and other potential third party funding sources. The Board considered the notion of a County matching contribution of up to $3,000,000, but took no action regarding that consideration; and

 

WHEREAS, the Board desires to consider the creation of an assessment district consistent with the Municipal Improvement Act of 1913 in order to fund the construction of the Improvements in cooperation with the La Honda community; and

 

WHEREAS, there has been presented to this Board information and testimony in support of the proposed Improvements.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that

 

1.

The Improvements are required for the convenience of the public, including providing the La Honda community and the Scenic Drive roadway with added protection against land movement.

 

2.

This Board declares its intention to order the work on the Improvements.

This Board intends to consider the formation of an assessment district in order to finance the construction of the Improvements, which assessment district has boundaries as shown on the map attached to this resolution and identified as Exhibit A, “Proposed Boundaries of La Honda Landslide Assessment District, San Mateo County, California,” which map, in full scale, is on file in the office of the Director of Public Works. Any surplus remaining in the improvement fund after the completion of the Improvements shall be used as a credit upon the assessment in the manner provided in Streets & Highways Code section 10427.1.

In addition to any assessment of County owned property lying within the assessment district, if an assessment district is formed and the assessments are paid, a portion of the costs and expenses of the Improvements shall be paid by the County. Said portion shall not exceed three million dollars, inclusive of any assessments paid by the County.

 

5.

In connection with the Improvements and the formation of an assessment district, the Director of Public Works shall make and file with the clerk of this Board a written report that satisfies the requirements of Street & Highways Code section 10204. The report shall be presented to this Board for consideration.
