RESOLUTION AUTHORIZING AND DIRECTING THE BOARD PRESIDENT TO EXECUTE A SECOND AMENDMENT TO LEASE AGREEMENT WITH BOREL ESTATE COMPANY OF OFFICE SPACE AT 1700 SOUTH EL CAMINO REAL, SAN MATEO, WHICH EXTENDS THE EXPIRATION DATE TO OCTOBER 31, 2012 WITH TWO OPTIONS TO EXTEND FOR ONE YEAR EACH AND INCREASES THE LEASED AREA TO 2,997 SQUARE FEET, AT AN INITIAL MONTHLY RENT OF $7,492.50, WITH A ONE-TIME CHARGE OF $35,000.00 FOR IMPROVEMENT WORK, AND AUTHORIZING THE COUNTY MANAGER OR HIS DESIGNEE TO EXECUTE NOTICES, OPTIONS AND DOCUMENTS ASSOCIATED WITH THE FIRST AMENDMENT AND LEASE INCLUDING, BUT NOT LIMITED TO, EXTENSION OR TERMINATION OF THE AGREEMENT UNDER THE TERMS SET FORTH THEREIN. (LEASE NO. 1259)

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on October 8, 2002, the County of San Mateo and Borel Estate Company, as authorized by Resolution No. 65601, entered into a Lease Agreement for office space at 1700 South El Camino Real, San Mateo, California; and

WHEREAS, on October 7, 2003, the County and Borel, as authorized by Resolution No. 66297, entered into a First Amendment to Lease, which Lease expired on October 31, 2007; and

 

WHEREAS, the parties wish to further amend the Lease to extend the termination date to October 31, 2012 with two options to extend for one year each and increases the leased area to 2,997 square feet, at an initial monthly rent of $7,492.50, which rate will increase 3% annually; and otherwise, on the same terms and conditions; and

 

WHEREAS, this Board has been presented with the Second Amendment to Lease and has examined and approved same as to both form and content and desires to enter into same.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby, authorized and directed to execute said Second Amendment to Lease for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto; and

 

IT IS FURTHER DETERMINED AND ORDERED that the County Manager or his designee is hereby authorized to accept or execute on behalf of the County, any and all written notices, options, consents, approvals and documents in connection with the Second Amendment and the Lease including, but not limited to, extension or termination of the agreement under the terms set forth therein.
