Election Services for Special Mail Ballot Election on May 6, 2008

 

RECOMMENDATION:

Adopt a resolution authorizing the Chief Elections Officer to render specified election services for the Portola Valley School District in conjunction with a special mail ballot election to be held on Tuesday, May 6, 2008.

Rendering the requested election services will facilitate public participation in the selection of a school district governing board member to fill a recent vacancy and thereby serve the needs of the district for representative and effective governance.

 

BACKGROUND:

On October 18, 2007, a vacancy occurred on the governing board of the Portola Valley School District. On December 13, 2007, the board duly adopted Resolution No. 3-2008, calling for a special mail ballot election to be held on May 6, 2008 to fill the vacancy, and approving a request to this honorable Board that the County’s Chief Elections Officer be authorized to provide related election services. Thereafter, the District entered into an agreement with the Chief Elections Officer, whereby the District will reimburse the County for all related costs.

 

DISCUSSION:

California Elections Code section 10002 provides for the governing body of any city or district to request the Board of Supervisors of the County to permit the County Elections Officer to render specified services to the city or district relating to the conduct of an election. Subject to approval of the Board of Supervisors, these services shall be performed by the Chief Elections Officer. Elections Code sections 4000 and 1500 provide for conducting an all-mail ballot election on the first Tuesday after the first Monday in May of any year.

 

This request of the governing board is proper and the County Elections Officer is agreeable to providing the specified election services as requested, and all related costs will be reimbursed by the requesting District.

 

This request has been reviewed and approved by County Counsel.

 

FISCAL IMPACT:

There is no Net County Cost. All costs will be reimbursed by the requesting District.
