RECOMMENDATION:
|
Adopt a resolution:
1. Authorizing the execution of a Second Amendment to the Lease Concession Agreement with John M. Bragg of certain real property in Wunderlich Park, Woodside, for a period of three years commencing February 26, 2008 at a monthly rent of $1,100, with two options to extend for an additional one year each,
2. Authorizing the County Manager or his designee to execute notices and documents associated with the Second Amendment and the Lease Concession Agreement including, but not limited to, extension or termination of the agreement under the terms set forth therein.

BACKGROUND:
|
Since 1974, the Parks Department has leased a portion of Wunderlich Park in Woodside for the exclusive purpose of operating a commercial horse stables concession. In April of 2007, the Director of Parks and Recreation issued a new Request for Proposals (RFP) for a commercial horse stables concession, inclusive of horse boarding, riding lessons and related services, that would require a future tenant to accommodate restoration of the historic Folgers Stable. The current tenant, John Bragg, was the only respondent to the RFP. Mr. Bragg is the current tenant under the existing lease; therefore, the existing lease is being amended to reflect the terms set forth in the RFP.

DISCUSSION:
|
The Second Lease Amendment negotiated by Real Property Services extends the term from a month to month tenancy to a term of three years commencing February 26, 2008, with two options to extend for an additional one year each. Monthly rent has been increased from $966 per month to $1,100 per month. The Amendment also revises the premises and terms of use to address anticipated improvements to Wunderlich Park and Folgers Stable.

County Counsel has reviewed and approved the Amendment as to form. The Director of Parks and Recreation concurs in this recommendation.

FISCAL IMPACT:
|
The monthly rent of $1,100 per month will be deposited into the Department of Parks fund.
