BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION AUTHORIZING AND DIRECTING THE BOARD PRESIDENT TO EXECUTE A SECOND AMENDMENT TO LEASE CONCESSION AGREEMENT WITH JOHN M. BRAGG, OF CERTAIN REAL PROPERTY IN WUNDERLICH PARK IN WOODSIDE, FOR A PERIOD OF THREE YEARS COMMENCING FEBRUARY 26, 2008 AT A MONTHLY RENT OF $1,100, WITH TWO OPTIONS TO EXTEND FOR AN ADDITIONAL ONE YEAR EACH, AND AUTHORIZING THE COUNTY MANAGER OR HIS DESIGNEE TO EXECUTE NOTICES AND DOCUMENTS ASSOCIATED WITH THE SECOND AMENDMENT AND LEASE CONCESSION AGREEMENT INCLUDING, BUT NOT LIMITED TO, EXTENSION OR TERMINATION OF THE AGREEMENT UNDER THE TERMS SET FORTH THEREIN. RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on March 16, 1993 the County of San Mateo and Patricia Holmes, as authorized by Resolution No. 56971, entered into a Lease Concession Agreement for the lease of certain real property in Wunderlich Park, Woodside, California; and

 

WHEREAS, on January 28, 2003 the County of San Mateo and Patricia Holmes as authorized by Resolution No. 65789, entered into a First Amendment to Lease Concession Agreement for the lease of such real property; and

 

WHEREAS, on or about June 26, 2006, Patricia Holmes assigned the Lease Concession Agreement as amended to John M. Bragg and County accepted said assignment by Resolution No. 68145 on July 18, 2006; and

 

WHEREAS, the parties wish to amend the term of the Lease Concession Agreement to a term of three-years commencing February 26, 2008 at a monthly rent of $1,100, with two options to extend the term for an additional one year each, and to otherwise make certain other revisions to the definition and use of the premises; and

 

WHEREAS, this Board has been presented with the Second Amendment to Lease Concession Agreement and has examined and approved same as to both form and content and desires to enter into same.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby, authorized and directed to execute said Second Amendment to Lease Concession Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto; and

 

IT IS FURTHER DETERMINED AND ORDERED that the County Manager or his designee is hereby authorized to accept or execute on behalf of the County, any and all written notices, options, consents, approvals and documents in connection with the Second Amendment and the Lease Concession Agreement including, but not limited to, extension or termination of the agreement under the terms set forth therein.
