SUBJECT:

Resolution Accepting the Certificate and Statement of the Vote of the Chief Elections Officer and Adopting the Results of the Official Canvass of the Votes Cast in the February 5, 2008 Presidential Primary Election

 

RECOMMENDATION:

Adopt a resolution:

(A)

Accepting the certificate of the Chief Elections Officer and adopting the statement of election results as determined by the official canvass of the votes cast in the February 5, 2008 Presidential Primary Election; and

(B)

Declaring the results of local ballot measures.

This resolution adopts the results of the election, honoring the opinions expressed by the County’s voters on candidates and important public issues, and declaring elected the successful candidates who have chosen to serve their communities.

 

BACKGROUND:

Pursuant to Elections Code sections 10411 and 15372, the Chief Elections Officer has, within 28 days of an election, canvassed all ballots and prepared and certified the statement of the results and delivered the certified results to the Board of Supervisors, and shall deliver a duplicate of that Statement of the Vote to the California Secretary of State and to the chairperson of the county central committee of each political party and to report the results to the governing body of each jurisdiction participating in the election. Upon acceptance of this statement, Elections Code section 15400 authorizes and directs the governing body of the jurisdiction to declare to declare the results as to each ballot measure voted on at the election.

 

DISCUSSION:

On February 5, 2008, the Chief Elections Officer conducted a Presidential Primary Election. Thereafter, the official canvass and Statement of the Vote was completed and certified by the Chief Elections Officer. The Statement of the Vote reports all election results, by precinct, for each office and measure voted on in the election. A copy of that document was submitted to this Board, and additional copies are available upon request.

 

County Counsel has reviewed and approved this resolution.

 

FISCAL IMPACT:

There is no Net County Cost and no fiscal impact.
