RECOMMENDATION:
|
Adopt an ordinance amending sections 2.24.030 and 2.24.040 of Chapter 2.24 of Title 2 of the San Mateo County Ordinance Code changing the membership composition of the Commission by naming the Director of the County Health Department as a required member and modifying the term descriptions to add flexibility for the Board with regard to Board appointed members.

BACKGROUND:
|
Pursuant to the current County Ordinance Code provisions, the “Chief of Pediatrics, San Mateo Medical Center” and the “County Manager, or his or her designee” have been required members of the nine-member First 5 San Mateo County Commission. However, the position of Chief of Pediatrics no longer exists and the current Commission has recommended that the Director of the County Health Department be included as a required member of the Commission. State law requires that County First 5 Commissions be made up of at least five and no more than nine members. In its original authorizing ordinance, the Board decided on a Commission composition of nine members.

State law also requires that at least two Commissioners be from among persons responsible for county functions in the areas of health, or the management of children’s services, public health services, behavioral health services, social services, or tobacco and other substance abuse prevention and treatment services. The remaining Commissioners must be from among the “positional” persons listed above, or persons from any of the following: recipients of project services included in the county strategic plan; educators specializing in early childhood development; representatives of a local child care resource or referral agency, or a local child care coordinating group; representatives of a local organization for prevention or early intervention for families at risk; representatives of community-based organizations that have the goal of promoting nurturing and early childhood development; representatives of local school districts; or representatives of local medical, pediatric, or obstetric associations or societies. Replacing the Chief of Pediatrics with the Director of the County Health Department as a Commission member is consistent with these requirements.

Because the existing designation of the “County Manager or his or her designee” as a member is not based on the positional or background criteria specified in state statute, this existing designation is being replaced with an additional appointment by the Board, so that the position can be filled with a person meeting statutory requirements.

DISCUSSION:
|
Allowing the Board of Supervisors to select five Commissioners provides flexibility to the selection process. Replacing a no-longer-existing position with the Director of the County Health Department adds an area of expertise to the Commission.

FISCAL IMPACT:
|
There is no impact to the General Fund.
