Agreement with El Centro de Libertad for enhanced services to Drug Court Clients

 

RECOMMENDATION:

Adopt a Resolution:

1) Waiving the Request for Proposals (RFP) requirement for enhanced services to Drug Court clients; and

 

2) Authorizing the President of the Board to execute an Agreement with El Centro de Libertad for enhanced services to Drug Court clients funded by a Drug Court Discretionary Grant for the term December 1, 2007 through September 30, 2008, for a maximum obligation of $150,000.

Services funded by this Agreement will contribute to this commitment and goal by providing intensive case management to chronic methamphetamine users. In addition, Drug Court provides access to a continuum of alcohol, drug and other related treatment and rehabilitation services that enable participants to make more positive decisions.

BACKGROUND:

The San Mateo County Drug Court was formed in 1995 to provide those arrested for nonviolent felony drug possession an opportunity for treatment rather than incarceration. The Drug Court was based on a model that recognizes drug abuse as a chronic relapsing disease and treats recovery as a long term process.

 

On March 6, 2007, San Mateo County Alcohol and Other Drug Services (AOD) and El Centro de Libertad submitted to the Department of Justice a proposal for enhancement of services for Drug Court clients using methamphetamine. In that proposal El Centro de Libertad was named as a provider of these services. On September 6, 2007, San Mateo County AOD was notified of a funding award for Drug Court Discretionary Grant funds to provide additional services to Drug Court participants for FY 2007-08. The Drug Court Discretionary Grant funding provides resources to state, local and tribal governments and state and local courts to establish or enhance adult drug courts and systems for nonviolent substance abusing offenders.

 

DISCUSSION:

Behavioral Health and Recovery Services (BHRS) is requesting a waiver of the RFP process requirement for these services. El Centro de Libertad will provide enhanced services to support existing Drug Court consumers with methamphetamine-specific treatment. These services have been designed in conjunction with the San Mateo County Superior Court, BHRS, the Contractor, and other community stakeholders with experience in providing services to methamphetamine users in the Drug Court Program. A minimum of 30 clients per fiscal year will receive case management, recovery support, contingency management and aftercare services for up to a year based on individual treatment plans reflecting the support that will best benefit each client.

 

BHRS currently has six other contracts with El Centro de Libertad for the provision of other services. The contracts reflect specific funding and service requirements.

 

This Agreement has been reviewed and approved by County Counsel and Risk Management. The Contractor has assured compliance with the County's Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination, and equal benefits.

 

This Agreement has been delayed because negotiations and the program development process took more time than had been anticipated.

 

FISCAL IMPACT:

The term of this Agreement is December 1, 2007 through September 30, 2008. The total contract obligation for this Agreement is $150,000 and is provided by the Drug Court Discretionary Grant. An appropriation in the amount of $105,000 has been included in the BHRS FY 2007-08 Adopted Budget, and $45,000 will be included in the FY 2008-09 Proposed Budget. There is no Net County Cost.
