RESOLUTION AUTHORIZING SUBMISSION OF 2007 LOCAL JAIL CONSTRUCTION FUNDING PROGRAM PROPOSAL TO THE CORRECTIONS STANDARDS AUTHORITY

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, both male and female adult detention facilities in the County of San Mateo are overcrowded and the Women’s Correctional Center WCC is in need of replacement; and

 

WHEREAS, building a new correctional facility will require a significant fiscal expenditure; and

 

WHEREAS, under the Public Safety and Offender Rehabilitation Services Act of 2007 (AB 900) the California Department of Corrections and Rehabilitation can enter into contracts with counties to pay for a significant portion of the construction costs of local jail facilities. To receive such funding the County needs to participate in a competitive process; and

 

WHEREAS, if the County were to participate in the AB 900 competitive process, the County could be awarded up to $100 million towards the construction costs of a new County jail, with a 25% funding match comprised of both cash and in kind contribution by the County; and

 

WHEREAS, this Board has been presented with the 2007 Local Jail Construction Funding Program Proposal and has examined and approved it, as to both form and content and desires to submit it to the California Department of Corrections and Rehabilitation:

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED:

1. The County Construction Administrator shall be Peter Yee, Projects Manager, Department of Public Works.

 

2. The Project Financial Officer shall be Reyna Farrales, Deputy County Manager.

 

3. The Project Contact Person shall be Lieutenant Deborah Bazan, Jail Planning Unit of the Sheriff’s Office.

 

4. The President of this Board of Supervisors be authorized and directed to sign the Applicant’s Agreement and submit the Local Jail Construction Funding Program Proposal on behalf of the County of San Mateo.

 

5. The County of San Mateo will adhere to state requirements and terms of the agreements between the County, the California Department of Corrections and Rehabilitation, the Corrections Standards Authority and the State Public Works Board in the expenditure of state funds and County matching funds.

 

6. The County will appropriate after the conditional project award, and before the state/County funding agreement, a 25% funding match that would be comprised of both cash and in kind contribution by the County. If the conditional project award is in the amount of $100,000,000 the County will also appropriate a 4% over match for a total match of $39,895,517. The source of the funds will be from County general funds and/or bond financing that is not secured by the proposed facility or any of its revenues. After these funds have been appropriated, the County assures that state and cash matching funds will not supplant funds otherwise dedicated or appropriated for construction activities.

 

7. The County will fully and safely staff and operate the facility that is being constructed (consistent with Title 15, California Code of Regulations) within (90) days after project completion.

 

8. The County assures that it has a project site located at 1590 Maple Street in Redwood City, California, that this site is owned by the County in fee simple, and that the County will not dispose of, modify the use of, or change the terms of the real property title, or other interest in the site of the facility subject to construction, or shall lease the facility for operation to other entities, without permission and instructions from the Correctional Standards Authority.

 

9. The County, through this Board of Supervisors, attests that $5,525,000 is the estimated current fair market land value for 1590 Maple Street in Redwood City, California, the proposed site of the new facility, and that the County will obtain an appraisal of the property after the conditional project award and before the State/County funding agreement is executed.
