SUBJECT:

Substance Abuse and Crime Prevention Act of 2000 (Proposition 36) and the Offender Treatment Program plans for Fiscal Year 2007-08

 

RECOMMENDATION:

Adopt a Resolution:

1)

Authorizing the President of the Board to approve the FY 2007-08 plans for a) the Substance Abuse and Crime Prevention Act (SACPA) of 2000; and b) the Offender Treatment Program (OTP); and

2)

Authorizing the President of the Board to transfer the designation as the County Lead Agency from the Human Services Agency to the Health Department, Behavioral Health and Recovery Services Division as the entity responsible for administration of the funds of both programs; and

3)

Delegating approval authority for future revisions to the San Mateo County SACPA and OTP plans to the Director of Health or designee through June 30, 2010.

BACKGROUND:

The Substance Abuse and Crime Prevention Act of 2000 (SACPA/Proposition 36), mandates that any person, probationer, or parolee convicted of a nonviolent drug possession offense, or who has violated any other drug-related condition of their sentence, shall be diverted from incarceration to a licensed or certified community-based alcohol and other drug treatment program.

 

On February 6, 2001, your Board adopted a resolution agreeing to comply with the provisions of SACPA as a condition of accepting FY 2000-01 SACPA funding. The Human Services Agency, Alcohol and Other Drug Services was identified as the lead agency and a County trust fund was established for funds received pursuant to SACPA. On June 19, 2001, your Board adopted a resolution approving the SACPA plan for FY 2001-02. Services to eligible SACPA offenders went into effect on July 1, 2001. On February 5, 2002, a resolution was adopted by your Board, pursuant to State regulations, delegating approval authority for the SACPA plan and future revisions to the Director of the Human Services Agency through June 30, 2006.

 

In 2006 Assembly Bill 1808 established the Offender Treatment Program (OTP) to provide more intensive treatment services and judicial supervision to offenders who had not successfully completed treatment under the requirements in SACPA. The goals of OTP are to improve SACPA offender accountability; increase admission, retention and completion outcomes; expand treatment capacity; and to obtain county investment through a 10% local match. Services to OTP offenders went into effect on November 13, 2006, in accordance with OTP requirements.

 

On January 29, 2007, your Board approved an Appropriation Transfer Request amending the FY 2006-07 Adopted Budget to enhance services for SACPA offenders with OTP funding.

 

DISCUSSION:

We are requesting approval of the FY 2007-08 SACPA and OTP plans. Approval of these plans will provide for continuity of the treatment and supervision system developed over the past six years. Measurement of treatment completion is required by the State as a surrogate indicator of success.

 

Subsequent to the organizational transfer of Alcohol and Other Drug Services from the Human Services Agency to the Health Department, the Health Department should be designated as the lead agency for the administration of SACPA and OTP. In addition, the approval authority for plan revisions through June 30, 2010, should be granted to the Director of Health or designee.

 

These plans were developed in partnership between Behavioral Health and Recovery Services; the Probation Department; the Court; the District Attorney’s Office; community-based treatment providers; the Human Services Agency and the County Manager’s Office. The development and approval of these plans was delayed as a result of the late adoption of the FY 2007-08 State Budget and subsequent, unanticipated SACPA and OTP funding reductions.

 

FISCAL IMPACT:

The funding period for the current SACPA and OTP plan is July 1, 2007 through June 30, 2008. The State funding for SACPA in San Mateo County is $1,439,473. In addition, the SACPA Trust Fund will expend $401,299, for a total of $1,840,772. State funding for OTP is $373,233 with a required in-kind match of $41,470, which is the Net County Cost for both SACPA and OTP.
