BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION: 1) AUTHORIZING THE PRESIDENT OF THE BOARD TO APPROVE THE FY 2007-08 PLANS FOR A) THE SUBSTANCE ABUSE AND CRIME PREVENTION ACT (SACPA) OF 2000; AND B) THE OFFENDER TREATMENT PROGRAM (OTP); AND 2) AUTHORIZING THE PRESIDENT OF THE BOARD TO TRANSFER THE DESIGNATION AS THE COUNTY LEAD AGENCY FROM THE HUMAN SERVICES AGENCY TO THE HEALTH DEPARTMENT, BEHAVIORAL HEALTH AND RECOVERY SERVICES DIVISION AS THE ENTITY RESPONSIBLE FOR ADMINISTRATION OF THE FUNDS OF BOTH PROGRAMS; AND 3) DELEGATING APPROVAL AUTHORITY FOR FUTURE REVISIONS TO THE SAN MATEO COUNTY SACPA AND OTP PLANS TO THE DIRECTOR OF HEALTH OR DESIGNEE THROUGH JUNE 30, 2010

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, pursuant to §9515 Title 9, California Code of Regulations, and in accordance with the State of California Alcohol and Drug Program (ADP) the County Lead Agency is responsible for coordination of the planning process, preparation, and implementation of the SACPA and the OTP Plans (Plans) and is required to comply with the provisions of the Health and Safety Code, Division 10.9, commencing with Section 11999.20 and the provisions of the California Code of Regulations in Division 4, Chapter 2.5; and

 

WHEREAS, this Board has been presented with a form of these Plans and has examined and approved them as to both form and content and desires to approve said Plans for the term of July 1, 2007 through June 30, 2008; and

 

WHEREAS, in compliance with the Substance Abuse and Crime Prevention Act of 2000 (SACPA) and Assembly Bill 1808 for the Offender Treatment Program (OTP) this Board wishes to transfer the designation as the County Lead Agency from Human Services Agency to the Health Department, Behavioral Health and Recovery Services Division as the entity responsible for administration of the funds of both programs; and

 

WHEREAS, it is anticipated that revisions to the Plans will be necessary throughout the term, making it expeditious to delegate approval authority for future revisions to the Plans to the Director of Health or designee through June 30, 2010:

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of the Board of Supervisors be, and is hereby authorized and directed to approve said Plans for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto; and

 

BE IT RESOLVED that the President of the Board of Supervisors hereby transfers the designation as the County Lead Agency from Human Services Agency to the Health Department, Behavioral Health and Recovery Services as the entity responsible for administration of the funds of both programs; and

 

BE IT FURTHER RESOLVED that the Director of Health or the Director's designee is hereby authorized to make future revisions to the San Mateo County SACPA and OTP plans through June 30, 2010.
