______________________________________________________________

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board of Supervisors, on July 18, 2006, adopted Resolution No. 068153, which authorized execution of an agreement with Carrier Commercial Service for the maintenance of the cogeneration and absorption chiller equipment at the Youth Services Center; and

WHEREAS, although the agreement anticipated that the term would start on July 1, 2006, the commencement was delayed due to a delay in the demonstration of acceptable performance of the system itself, and Carrier could not begin to perform to the terms of the contract until July 31, 2007; and

WHEREAS, the parties have agreed to change the term of the original agreement to August 1, 2007 through July 31, 2011 and to accept all other conditions of the original contract; and

WHEREAS, the Director of Public Works recommends execution of the amendment to the contract with Carrier Commercial Services to provide said maintenance and warranty; and to authorize the Director of Public Works to exercise the one-year extension option; and

WHEREAS, this Board has considered and concurs in the recommendation of the Director of Public Works.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of the Board is hereby authorized to execute an amendment to the agreement with Carrier Commercial Services for the maintenance and warranty of the cogeneration and absorption chiller equipment at the Youth Services Center to change the term to August 1, 2007 through July 31, 2011, and to authorize the Director of Public Works to exercise the one-year extension option.
