Agreement with Stanford Hospital and Clinics for Medical Direction and Consultation to the Emergency Medical Services Program

 

RECOMMENDATION:

Adopt a Resolution:

1) Waiving the Request for Proposal process for selection of a provider for medical direction and consultation; and

 

2) Authorizing the President of the Board to execute an Agreement with Stanford Hospital and Clinics for medical direction and consultation to the Emergency Medical Services program for the term of March 1, 2008 through February 28, 2009 in an amount not to exceed $102,540.

The services provided by this contract contribute to this commitment and goal by providing medical oversight of the EMS system, ensuring efficient and medically appropriate care by emergency medical responders for residents of San Mateo County.

BACKGROUND:

California law requires that each local Emergency Medical Services (EMS) agency have a Medical Director and specifies that these services may be provided by contract.

 

Prior to 2007 the University of California, San Francisco provided these services through its employee Dr. Karl A. Sporer. When this contract ended in December 2006, the Health Department solicited applications for a new medical director through a mailing to all California EMS agencies and to local emergency physicians. Five responses were received and all were considered by a panel. Dr. Eric Weiss, an employee of Stanford Hospital and Clinics, was selected by this panel. The candidate that was ranked second in the process was Dr. Gregory Gilbert, also an employee of Stanford. In 2007 Dr. Weiss served as the County EMS Medical Director through a contract between the County and Stanford. This contract ended December 31, 2007.

 

DISCUSSION:

Under the new contract with Stanford, services will be provided by its employee Dr. Greg Gilbert who will be assisted by Dr. Peter D’Souza, also a Stanford employee.

As medical director, Dr. Gilbert will be responsible for oversight of the local EMS system, create medical treatment protocols, develop medical policy, and conduct medical research, in addition to other duties.

 

The contractor has assured compliance with the County's Contractor Employee Jury Service Ordinance, insurance and some of the contract provisions that are required by County ordinance and administrative memoranda. A mutual hold harmless provision is included in the Agreement. The County Manager has approved modification of the equal employment opportunity and non-discrimination language as requested by the Contractor.

 

An RFP waiver is requested for the selection of the medical director because the contract opportunity was widely advertised at the end of 2006 when Stanford was selected as the contractor. Dr. Gilbert, who is also a Stanford employee, was ranked as number two by the panel.

 

County Counsel has reviewed and approved the Agreement as to form and content. Risk Management has reviewed and approved the insurance coverage.

 

FISCAL IMPACT:

The term of the Agreement is March 1, 2008 through February 28, 2009. The maximum contract amount is $102,540, which is the same as the previous contract for medical direction. The cost of this Agreement for FY 2007-08 is $34,180, and is included in the EMS FY 2007-08 Adopted Budget. The cost of this Agreement for FY 2008-09 is $68,360 and will be included in the EMS FY 2008-09 Recommended Budget. There is no Net County Cost as a result of this Agreement.
