RESOLUTION FORMING THE LA HONDA LANDSLIDE ASSESSMENT DISTRICT,
LEVYING THE ASSESSMENT TO FINANCE THE COST OF CONSTRUCTING SOIL STABILITY IMPROVEMENTS AND RECONSTRUCTING LOWER SCENIC DRIVE, AND ORDERING THE PROPOSED IMPROVEMENTS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, Resolution No. 069259, adopted February 12, 2008, approved the Engineer’s Report (“Engineer’s Report”) concerning the soil stability improvements and reconstruction of lower Scenic Drive in La Honda (the “Improvements”); declared the intention of the Board to form an assessment district and to assess the parcels within the proposed district for a portion of the cost of constructing the Improvements; and set Tuesday, the 22nd day of April 2008, for a public hearing to consider any and all objections to the formation of said assessment district and the levying of assessments; and

 

WHEREAS, the notice, protest and hearing requirements imposed by Government Code section 53753 have been complied with, and this Board has considered any and all comments, objections and testimony presented at the public hearing; and

 

WHEREAS, a majority protest does not exist; and

 

WHEREAS, the Engineer’s Report set forth proposed assessment amounts that were based on an inaccurate count of the number of assessment units within the proposed assessment district and the corrections to those figures and calculations (“Engineer’s Report Addendum”) have been presented this Board for consideration and approval.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

 

1.

The ballot proceedings satisfactorily met all applicable requirements, and there is not a majority protest within the limit of the assessment district based on the ballots received, weighted proportionately to the value of the proposed assessments.

 

2.

The Engineer’s Report and the Engineer’s Report Addendum (together the “Final Engineer’s Report”) and the assessments as set forth therein are confirmed and approved.

 

3.

An assessment district as described in the Final Engineer’s Report, hereinafter to be known as the La Honda Landslide Assessment District (“District”), is hereby formed pursuant to the Municipal Improvement Act of 1913 for the purposes of constructing soil stability improvements and reconstructing lower Scenic Drive within the landslide area.

 

4.

The assessments set forth in the Final Engineer’s Report are to be levied and the Improvements are to be constructed.

 

5.

The Director of Public Works is hereby authorized and directed to undertake all actions, and to complete all documentation, notices and filings, necessary or appropriate for the formation of the District and imposition and levying of the assessments set forth in the Final Engineer’s Report, including without limitation notifying property owners and placing the assessments on the Assessment Tax Roll.
