RESOLUTION FINDING THAT AN EMERGENCY EXISTS THAT WILL NOT PERMIT A DELAY RESULTING FROM A COMPETITIVE SOLICITATION FOR BIDS, AND THAT EMERGENCY REPAIR WORK IS NECESSARY TO RESPOND TO THE EMERGENCY, AND AUTHORIZING THE EXECUTION OF A CONSTRUCTION CONTRACT WITH SOIL ENGINEERING CONSTRUCTION, INC. FOR THE FINAL DESIGN CONSTRUCTION OF THE IMPROVEMENTS WITHIN THE LA HONDA LANDSLIDE ASSESSMENT DISTRICT WITHOUT A COMPETITIVE SOLICITATION FOR BIDS (PROJECT NO. R2E01 – F-36 [256])

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the Scenic Drive area of La Honda has in the past been declared a disaster area due to the landslide in the area; and

WHEREAS, over the past several years this Board has authorized several projects aimed at trying to help stabilize the land under and adjacent to Scenic Drive, including the construction of a french drain system on the failed hillsides adjacent to Scenic Drive; and

WHEREAS, it has been reported that the land under and adjacent to Scenic Drive continues to slide; and

WHEREAS, continued land movement will undermine the stabilization efforts already in place or underway; and

WHEREAS, the public interest and general welfare will be served by performing the stabilization work as emergency repair work in an expedited manner before the 2008-2009 rainy season; and

WHEREAS, a contractor must be selected utilizing a streamlined design/build type process in order to construct the stabilization improvements and help prevent further land movement, and provide protection of lives and property, and existing stabilization work and improvements; and

WHEREAS, the La Honda Landslide Assessment District (“District”), has been formed pursuant to the Municipal Improvement Act of 1913 for the purposes of constructing improvements described in the Final Engineer’s Report approved by the Board (the “Improvements”); and

WHEREAS, general design plans for the Improvements the have been prepared and have been approved by the Director of Public Works, and said plans have been filed in the office of the Director of Public Works (the “plans”); and

WHEREAS, the Director of Public Works has determined that the using Soil Engineering Construction, Inc to construct the Improvements will be in the best interest of the District and of the County in addressing the emergency situation.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

It is found that, with regard to the La Honda landslide area, an emergency exists that will not permit a delay resulting from a competitive solicitation for bids, and that emergency repair work in the form of the Improvements as described in the Final Engineer’s Report, is necessary to respond to the emergency.

2.

The plans are hereby approved and adopted as the plans to be adhered to in letting and performing the work under a contract for the Improvements.

3.

On behalf of the County of San Mateo, the President of this Board of Supervisors shall be, and is hereby, authorized and directed to enter into a design/build type agreement with Soil Engineering Construction, Inc., for the final design and construction of the Improvements to address the emergency without a competitive solicitation for bids.

4.

All payments to the Contractor shall be in accordance with the plans and other contract documents, based on the Director of Public Works’ written estimate of work actually done.
