A RESOLUTION 1) CERTIFYING THAT THE FINAL HUDDART/WUNDERLICH
PARKS MASTER PLAN PROGRAM ENVIRONMENTAL IMPACT REPORT AND MITIGATION MONITORING AND REPORTING PLAN ARE ADEQUATE AND PREPARED IN ACCORDANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT; AND 2) APPROVING THE FINAL HUDDART/WUNDERLICH PARKS MASTER PLAN DATED MAY 2006

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the California Environmental Quality Act (CEQA), the State CEQA Guidelines and the County CEQA Guidelines provide that the County must certify that a Final EIR prepared for a project that may have significant environmental effects has been completed in compliance with CEQA; and

 

WHEREAS, in August 2006, the County prepared an Initial Study of the Huddart/Wunderlich Master Plan which determined it was a project subject to CEQA, and on September 12, 2006 the Board of Supervisors directed staff to prepare a Program Environmental Impact Report to address potentially significant environmental impacts as a result of the project; and

 

WHEREAS, the County prepared, published and circulated, pursuant to the requirements of CEQA and the State CEQA Guidelines, a Notice of Preparation released on November 15, 2006 to obtain comments from interested parties and agencies on the proposed scope of the Environmental Impact Report; and

 

WHEREAS, the County’s Parks and Recreation Commission held a scoping session on November 29, 2006 and extended the comment period from November 29, 2006 to January 15, 2007 in response to public request; and

 

WHEREAS, a Draft Program EIR was sent on July 16, 2007 to the State Clearinghouse, State and local agencies, special districts, public libraries and other known interested parties, and was made available to the general public, thereby commencing a 45-day period (July 16, 2007 until August 30, 2007) for public review and comment on the adequacy and contents of the Draft Program EIR in accordance with the requirements of CEQA; and

 

WHEREAS, the County Parks Commission held a public hearing on August 2, 2007 and received written and verbal public comments on the Draft Program EIR which were made part of the record of comments therewith; and

 

WHEREAS, the County Parks Commission at the conclusion of the public hearing on August 2, 2007 extended the public comment period until September 12, 2007; directed staff to respond to all verbal and written comments received during the extended public comment period on the Draft Program EIR and recommended that the Board of Supervisors certify the Final Huddart/Wunderlich Parks Master Plan Program Environmental Impact Report and Mitigation Monitoring and Reporting Plan and approve the Final Huddart/Wunderlich Parks Master Plan; and

 
 
 

WHEREAS, on September 12, 2007, the 58-day public comment period ended on the Draft Program Environmental Impact Report; and

 

WHEREAS, December 2007, the County completed and published the Final Huddart/Wunderlich Parks Program Environmental Impact Report containing all comments received by the County on the Draft EIR, responses to those comments raising environmental issues and revisions to the Draft EIR text made thereby, changes to mitigation measures in connection therewith, and additional environmental information with respect thereto; and

 

WHEREAS, the Final Huddart/Wunderlich Parks Master Plan Program EIR was made available to the public and distributed in accordance with the requirements of CEQA, and made available to those public agencies and individuals who had submitted comments on the Draft Program EIR; and

 

WHEREAS, Public Resources Code Section 21081.6 requires that when a public agency adopts findings pursuant to Public Resources Code Section 21081 (concerning potential significant environmental impacts that will be generated by a project being approved), the public agency must adopt a Mitigation Monitoring and Reporting Plan for the changes to the project that it has adopted or made a condition of project approval in order to mitigate or avoid significant effects on the environment; and

 

WHEREAS, the Board of Supervisors received and the Board of Supervisors has heard, and has been presented with and is familiar with all of the information in the administrative record, has reviewed and considered the information in the Draft Huddart/Wunderlich Parks Master Plan Program EIR , and the Final Huddart/Wunderlich Parks Master Plan Program EIR for completeness and compliance with California Environmental Quality Act (CEQA), the State CEQA Guidelines and the County’s CEQA Guidelines, and has independently reviewed and analyzed the Final Huddart/Wunderlich Parks Master Plan Program EIR and Mitigation Monitoring and Reporting Plan.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors, based on the foregoing facts and circumstances, and the administrative record concerning the Final Huddart/Wunderlich Parks Master Plan Program EIR, which includes the public written and oral testimony received on the Draft Program EIR and the Final Program EIR, finds and determines that:

   

1.

The Final Huddart/Wunderlich Parks Master Plan Program EIR is complete, correct, and adequate and prepared in accordance with CEQA.

   

2.

The Final Huddart/Wunderlich Parks Master Plan Program EIR consists of the following documents:

a.

The Draft Program EIR (July 2007)

b.

The Final Program EIR (dated December 2007), which includes 1) revisions to the Draft Program EIR made in response to comments, 2) comments received from the public, written and oral, and written responses to public comments, and 3) the Mitigation Monitoring and Reporting Plan.

   

3.

All comments made on the Draft Program EIR that raised environmental issues were responded to adequately in the Final Program EIR pursuant to the requirements of CEQA, and the Final Program EIR does not contain significant new information requiring additional public review.

 

4.

Changes or alterations have been required in, or incorporated into, the project which mitigate or avoid the significant effects on the environment.

   

5.

The Final Program EIR reflects the independent judgment of the County Board of Supervisors.

   

6.

The Final Program EIR has been completed and processed in accordance with the requirements of CEQA, the State CEQA guidelines, and the County’s CEQA guidelines.

   

7.

The Statement of Findings and Facts in Support of Findings regarding the Huddart/Wunderlich Parks Master Plan, attached to this Resolution as Exhibit 1, is adopted.

   

8.

The Mitigation Monitoring and Reporting Plan for the Huddart/Wunderlich Parks Master Plan, which is located in the Final Program EIR, dated December 2007, is adopted.

   

9.

The Final Huddart/Wunderlich Parks Master Plan dated May 2006 based on clarifications identified in the Final Program EIR is adopted.

   

10.

The administrative record can be found at the office of the San Mateo County Parks Department, located at 455 County Center, 4th Floor, Redwood City, CA 94063. The Master Plan, Draft Program EIR and the Final Program EIR can be viewed at the County Manager’s Office or online at www.eparks.net.
