RESOLUTION REJECTING THE BIDS RECEIVED AND AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO RE-ENGINEER AND RE-ADVERTISE THE MIDCOAST DRAINAGE IMPROVEMENT PROJECT – CYPRESS AVENUE FROM HIGHWAY 1 TO ETHELDORE STREET, ETHELDORE STREET FROM SUNSHINE VALLEY ROAD TO VERMONT AVENUE, AND SUNSHINE VALLEY ROAD FROM STETSON STREET TO ETHELDORE STREET – MOSS BEACH AREA

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board of Supervisors did, on February 26, 2008, adopt Resolution No. 069295, which resolution approved the specifications, determined the prevailing wage scales and called for the sealed proposals for the installation of drainage improvements on portions of Cypress Avenue, Etheldore Street and
Sunshine Valley Road in the Moss Beach Area; and

WHEREAS, the Clerk of this Board of Supervisors did, in public on March 18, 2008, open and examine all sealed proposals that were received in the specified time for the doing of the work referred to in said Resolution No. 069295; and

WHEREAS, Section 22038 of the Public Contract Code provides that a public agency, at its discretion, can reject all bids, as presented and re-advertise the same work for bids; and

WHEREAS, the Director of Public Works has recommended that the bids be rejected and that the Director of Public Works be authorized to re-engineer and
re-advertise the project for bid.

WHEREAS, this Board has considered and concurs with the recommendation of the Director of Public Works.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

1.

The bids received on March 18, 2008 are hereby rejected.

2.

The Director of Public Works is hereby authorized to re-engineer the project using more cost-effective material and re-advertise the project for bid in
June 2008 as provided by Section 22038 of the Public Contract Code.

3.

The Director of Public Works is authorized to extend the call for bid and bid opening up to sixty (60) days beyond the time and date originally set forth by the Board of Supervisors.

4.

The Department of Public Works is authorized and directed to issue a call for sealed proposals to be received by the County Manager/Clerk of the Board of Supervisors, Hall of Justice and Records, 400 County Center (formerly 401 Marshall Street), Redwood City, California, San Mateo County, on or before 2:30 p.m., Tuesday, June 24, 2008, in said office in the Hall of Justice and Records, Redwood City, California. Said bids will then be transmitted to the Board of Supervisors’ Chambers in said Hall of Justice and Records and be publicly opened and declared.
