SUBJECT:

Fourth Amendment to Agreement with Christopher A. Joseph & Associates (CAJA) for the Preparation of an Environmental Impact Report (EIR) for the Ascension Heights Subdivision.

 

RECOMMENDATION

A.

Adopt a Resolution:

   
 

1.

Authorizing the execution of a fourth Amendment to the Agreement with CAJA to prepare Draft and Final Environmental Impact Reports for the Ascension Heights Subdivision to extend the term from July 1, 2007 to June 30, 2009 and to increase the maximum amount expendable thereunder by $47,665 from $93,816 to $141,481.

     
 

2.

Authorizing the Director of Community Development or the Director’s designee to execute contract amendments which modify the County’s maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.

     

B.

Authorize an Appropriation Transfer Request (ATR) in the amount of $47,665 from Unanticipated Revenue to Contractual Services.

This Amendment contributes to the goal by providing the Board of Supervisors with sufficient information about potential impacts of this project upon which to make an informed decision regarding this land use request.

BACKGROUND

On June 16, 2003, the County entered into a multi-phase Agreement with CAJA to perform environmental consulting services to prepare a Draft Environmental Impact Report (DEIR) and a Final Environmental Impact Report (FEIR) and a Mitigation Monitoring Reporting Program for a proposed subdivision located at Ascension Drive and Bel Air Road in the unincorporated San Mateo Highlands. The Agreement has been amended three times to extend its term through June 30, 2007. The applicant is proposing to subdivide the existing parcel into lots for 25 homesites.

 

DISCUSSION

The FEIR was to have been completed by June 30, 2007. However, unforeseen changes in the project description have delayed completion of the DEIR.

 

In addition to again extending the term of the Agreement, the proposed fourth Amendment includes the following modifications to the original Scope of Work, which the Contractor has agreed to perform for an additional $47,665:

 

1.

Updating Chapters 1 (Summary) and 2 (Environmental Setting) of the EIR,

2.

Substantial updates to Chapter 4, the Environmental Impact Analysis, especially the Existing Vegetation and Wildlife section,

3.

Updating Chapter 6, Project Alternatives, to include analysis of the alternative proposed by the applicant,

4.

Additional time and expenses associated with public hearings and with preparation, circulation, and production of the Draft and Final EIRs.

   

The Contractor has assured compliance with the County’s Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits. The County Manager has approved the waiver of the extension of the contract beyond the three-year maximum.

 

County Counsel has reviewed and approved the Resolution and Amendment as to form.

 

FISCAL IMPACT

The proposed Amendment increases the maximum amount payable pursuant to the Agreement by $47,665 for a total of $141,481, which amount the County is being reimbursed by the applicant, San Mateo Real Estate and Construction. The proposed Amendment will also extend the term of the Agreement from July 1, 2007 until June 30, 2009 to allow for additional time to complete the remaining work. There is no net County cost associated with this Amendment.
