RESOLUTION IN OPPOSITION TO PROPOSITION 98, THE CALIFORNIA PROPERTY OWNERS AND FARMLAND PROTECTION ACT

______________________________________________________________

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, a constitutional amendment ballot measure, Proposition 98, will appear on California’s June 2008 ballot; and

WHEREAS, Proposition 98 would phase out rent control, a source of affordable housing, in local California jurisdictions including the City of East Palo Alto; and

WHEREAS, Proposition 98 could restrict California’s ability to meet its water needs by prohibiting the use of eminent domain to acquire land or water to develop public water projects needed to provide residents, businesses, farmers and the economy with reliable and safe water supplies; and

WHEREAS, Proposition 99, the Homeowners and Private Property Protection Act, provides protections from eminent domain without restrictions on rent control and other local government activities such as meeting community water needs;

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors by adoption of this resolution opposes Proposition 98, the California Property Owners and Farmland Protection Act.
