BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

ADOPT A RESOLUTION APPROVING DISPOSAL OF THREE OFF-ROAD DIESEL VEHICLES IN THE DEPARTMENT OF PARKS’ CONSTRUCTION EQUIPMENT FLEET TO BE REPLACED BY THREE NEW LOW-EMISSION VEHICLES PURCHASED WITH CALIFORNIA AIR RESOURCES BOARD GRANT FUNDS AND AS REQUIRED BY TERMS OF THE GRANT AGREEMENT BETWEEN THE COUNTY OF SAN MATEO AND THE CALIFORNIA AIR RESOURCES BOARD

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on June 5, 2007, the Board of Supervisors adopted Resolution #068773 approving the acceptance of a $260,305 California Air Resources Board Low Emissions Construction Equipment Grant for the purchase of three off-road diesel vehicles and plug-in diesel particulate filter retrofit equipment for these vehicles; and

 

WHEREAS, said procedures established by the California Air Resources Board require the grantee to certify by resolution the acceptance of such grant agreement and its terms and conditions; and

 

WHEREAS, the California Air Resources Board requires that engines or equipment to be replaced must be scrapped within 90 days of being replaced; and

 

WHEREAS, for purposes of the grant agreement, “scrapped” means destroying or rendering the ”equipment” useless either by punching a hole in the engine block, and/or cutting the structural components of the equipment, or some other manner acceptable to the California Air Resources Board; and

 

WHEREAS, San Mateo County Ordinance Section 2.83.120 Disposal of Unneeded Personal Property states that “if the estimated value of surplus property exceeds, in the opinion of the Purchasing Agent, the sum of $10,000, he shall first report such fact to the Board of Supervisors and obtain the Board of Supervisors’ approval prior to any disposition of such property; and

 

WHEREAS, the County’s Purchasing Agent has determined that the estimated value of the three off-road diesel vehicles owned by the County Department of Parks, and which are to be replaced with new off-road vehicles having environmental protection features, exceeds the sum of $10,000.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors by adoption of this resolution hereby approves disposal of three off-road diesel vehicles in the Department of Parks’ Construction Equipment Fleet to be replaced by three new low-emission vehicles purchased with California Air Resources Board grant funds and as required by terms of the grant agreement between the County of San Mateo and the California Air Resources Board.
