SUBJECT:

Ground Lease Agreement with MetroPCS for the installation and operation of a wireless communication facility at Flood Park, 215 Bay Road, Menlo Park (Permit No. 5326).

 

RECOMMENDATION:

Adopt a resolution:

    A) Authorizing the execution of a Ground Lease Agreement with MetroPCS for the installation and operation of a wireless communication facility at Flood Park, 215 Bay Road, Menlo Park, at an initial monthly rate of $2,100, for a term of five years with one option to extend for an additional five years, and

    B) Authorizing the County Manager or his designee to execute notices, options and documents associated with the Agreement including, but not limited to, extension or termination of the Agreement under the terms set forth therein.

The Agreement contributes to this commitment and goal by establishing an agreement that benefits the County of San Mateo and MetroPCS while also benefiting the public.

 

BACKGROUND:

MetroPCS has submitted a proposal to occupy a portion of Flood Park for the installation, operation and maintenance of a wireless communication facility. The installation will include a fenced equipment pad and three antennas concealed inside a new flagpole. County staff has been working with MetroPCS to coordinate the location and installation of the equipment. MetroPCS has received an approval from County Planning and has applied for a building permit for the improvements.

 

DISCUSSION:

Real Property Services has negotiated a Ground Lease Agreement for a term of five years with one option to extend for an additional five years. The agreement includes a $2,500 initiation fee to partially offset the cost of preparing the agreement. The initial monthly fee of $2,100 is subject to an annual escalation of 3%. The Agreement provides that the installation of the equipment be subject to approval of County staff and shall not interfere with Park uses.

 

County Counsel has reviewed and approved the Agreement as to form. The Director of Parks concurs in this recommendation.

 

FISCAL IMPACT:

The fee of $25,200 for the initial year of the five-year term will be deposited to the Department of Parks Fund, and the one-time initiation fee of $2,500 offsets a portion of the cost of Real Property Services staff time for the preparation of the Agreement.
