RESOLUTION AUTHORIZING THE SHERIFF AND THE COUNTY MANAGER OR THE MANAGER’S DESIGNEE TO: A) EXECUTE AMENDMENT NO. 2 TO THE EXISTING AGREEMENT WITH THE SAN MATEO COUNTY TRANSIT DISTRICT (SAMTRANS) FOR PROVISION OF LAW ENFORCEMENT, INVESTIGATION, AND PUBLIC SAFETY DISPATCH SERVICES; AND B) EXECUTE FUTURE AMENDMENTS TO SAID AGREEMENT, PROVIDED NO ADDITIONAL COUNTY COST IS INCURRED AND THERE ARE NO ADVERSE IMPACTS TO COUNTY SERVICES

 
 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that:

 

WHEREAS, this Board of Supervisors and the Governing Board of the San Mateo County Transit District (SAMTRANS), acting for and on behalf of SAMTRANS and the Peninsula Corridor Joint Powers Authority did, on December 14, 2004, enter into an Agreement (No. 67118) for the provision of law enforcement services by the Sheriff’s Office Transit Police Bureau ,and of public safety dispatch services by the Public Safety Communications Division of the County Manager’s Office to said entities; and

 

WHEREAS, this Board, on January 31, 2006, authorized the Sheriff to execute Amendment No. 1 (No. 67804) to said Agreement, for the addition of explosives detection canine services and a Transit Police Unit Lieutenant position; and

 

WHEREAS, SAMTRANS has proposed an extension of the existing Agreement for an additional three year period from July 1, 2008 through June 30, 2011, with a full continuation of all existing services, and further has proposed the addition of three Sheriff’s deputies within the contracted Transit Police Bureau effective as of April 1, 2008, in the total additive amount of $203,990 for the existing contract period April 1 through June 30, 2008, and $10,529,650 for the three year extension period through June 30, 2011; and

 

WHEREAS, this Board finds that it is in the interests of public safety that the Sheriff of San Mateo County, and the County Manager or the Manager’s designee, be empowered to execute future Amendments to said existing Agreement, so as to respond quickly to emerging law enforcement and homeland security situations at the request of SAMTRANS administration, provided said Amendments: a) are reviewed and approved by both the Sheriff and the County Manager, and by County Counsel as to legal form; b) do not result in any increased cost to the County’s General Fund; c) do not adversely impact the County’s ability to provide ongoing law enforcement and public safety communications services to County residents; and d) that this Board is duly and promptly notified of the terms and services of said Amendments; and

 

WHEREAS, this Board has been presented with a form of said Second Amendment to the Agreement, providing for said three positions for the balance of Fiscal 2007-08, and extending the term of all services through June 30, 2011; and has examined said document as to both form and content, and desires to enter into same:

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED THAT the Sheriff of San Mateo County and the County Manager or the Manager’s designee are hereby authorized and directed to execute said Second Amendment to the Agreement between the County of San Mateo and SAMTRANS for and on behalf of the County, and are further authorized to execute future amendments to the existing Agreement, within the conditions set forth above; and the Clerk of the Board shall receive a copy of said Amendment No. 2 and any future Amendments, with their signature thereto.
