RESOLUTION AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE THE FOURTH AMENDMENT TO EACH OF THE AGREEMENTS WITH CATHOLIC CHARITIES CYO; CITY OF SOUTH SAN FRANCISCO; MILLS-PENINSULA SENIOR FOCUS, INC.; AND PENINSULA VOLUNTEERS, INC., FOR ADULT DAY CARE SERVICES, INCREASING THE COLLECTIVE AMOUNT BY $130,000 FOR FY 2008-09 FOR A TOTAL OF $554,800 WITH NO CHANGE TO THE TERM OF JULY 1, 2005 THROUGH JUNE 30, 2009

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, on September 13, 2005, your Board adopted Resolution 67528 approving Agreements with Catholic Charities CYO; City of South San Francisco; Mills-Peninsula Senior Focus, Inc.; and Peninsula Volunteers, Inc., for the provision of adult day care services in the amount of $141,600 for the term of July 1, 2005 through June 30, 2009; and

WHEREAS, on April 13, 2006, the Director of Health approved the First Amendment to the Agreements, adding State required language regarding an appeals process and restrictions around lobbying, as well as County required language regarding contractor employee jury service, with no change to the amount or terms of the Agreements; and

WHEREAS, on June 27, 2006, your Board adopted Resolution 68108 approving the Second Amendment to the Agreements, increasing the collective amount by $141,600 for the period July 1, 2006 through June 30, 2007 for a total obligation of $283,200 with no change to the terms; and

WHEREAS, on September 11, 2007, your Board adopted Resolution 68971 approving the Third Amendment to the Agreements, increasing the collective amount by $141,600 for the period July 1, 2007 through June 30, 2008 for a total obligation of $424,800 with no change to the terms; and

WHEREAS, the parties wish to further amend the Agreements by increasing the collective amount by $130,000 for the period July 1, 2008 through June 30, 2009, changing the total obligation to $554,800 with no change to the terms July 1, 2005 through June 30, 2009 for the purpose of continuing adult day care services; and

WHEREAS, the Board has examined the Fourth Amendment to the Agreements and has approved them as to both form and content:

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be and is hereby authorized and directed to execute said Fourth Amendment to the Agreements for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.
