RESOLUTION
1. AUTHORIZING A THIRD AMENDMENT TO THE AGREEMENT WITH ENGINEERING ECONOMICS, INC. TO PROVIDE CONTINUING COMMISSIONING SERVICES FOR THE YOUTH SERVICES CENTER (YSC), INCREASING THE NOT TO EXCEED FEE BY $40,000 FROM $270,831 TO $310,831 AND EXTENDING THE TERM OF THE CONTRACT FROM JUNE 30, 2007 TO DECEMBER 31, 2008; AND
2. MAKING A FINDING THAT IT IS IN THE BEST INTEREST OF THE COUNTY TO WAIVE THE REQUEST FOR PROPOSAL PROCESS FOR THIS EXTENSION

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, by Resolution No. 065673, the County entered into an Agreement dated November 12, 2002, with Engineering Economics, Inc. to provide building commissioning services for the San Mateo County Youth Services Center project; and by Resolution No. 068206 executed Amendment 1 on August 15, 2006 increasing the fee by $42,372 from $191,739 to $234,111; and by Resolution No. 068542 executed Amendment 2 on February 13, 2007 increasing the fee by $36,720 from $234,111 to $270,831 and extending the term of the Agreement to June 30, 2007; and

 

WHEREAS, the original Agreement was based on an estimate of services to be provided; and

 

WHEREAS, the scope of the work required under this Agreement has subsequently increased, thereby necessitating a further amendment to the agreement; and

 

WHEREAS, this Agreement extension could not be developed until Turner Construction, which was the contractor that constructed the facility, made sufficient progress on the punch list items for the YSC and EEI has therefore not been able to complete the commissioning process and;

 

WHEREAS, it is anticipated that progress will be made on these issues shortly; and

 

WHEREAS, it is necessary to increase the amount and effective period of the contract to complete the building commissioning and;

 

WHEREAS, it is in the best interest of the County to waive the Request for Proposals process so that this agreement can be extended beyond three years; and

 

WHEREAS, this Board has considered the recommendation of the Director of Public Works, and has been presented with the Third Amendment to the Agreement and has approved it as to both form and content, and desires to enter into same:

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED, that

The President of the Board of Supervisors is hereby authorized and directed to execute an Amendment to the Agreement with Engineering Economics, Inc. for an additive amount of $40,000 increasing the not to exceed amount from $270,831 to $310,831 and an extension of time from June 30, 2007 through December 31, 2008, for and on behalf of the County of San Mateo, and the Clerk of the Board shall attest the President’s signature thereto; and

That the Board hereby makes a finding that it is in the best interest of the County to waive the Request for Proposal process for this extension.
