RESOLUTION AWARDING AND AUTHORIZING EXECUTION OF A CONTRACT FOR THE
FISH PASSAGE BARRIER MODIFICATIONS TO SEQUOIA FLAT CROSSING, MEMORIAL PARK, CALIFORNIA (PROJECT NO. OD029)

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board of Supervisors did, on May 1, 2007, adopt Resolution
No. 068689, which Resolution adopted the specifications and determined the prevailing wage scales, and on May 20, 2008, adopted Resolution No. 069441 calling for sealed proposals for the Fish Passage Barrier Modifications to Sequoia Flat Crossing at Memorial Park, California project; and

WHEREAS, the Clerk of this Board of Supervisors did, in public on June 10, 2008, open and examine all sealed proposals that were received in the specified time for the doing of the work referred to in said Resolution No. 069441; and

WHEREAS, this Board of Supervisors has caused an analysis of said proposals to be made by the Director of Public Works of the County of San Mateo, and has, in open session, fully reviewed and considered said sealed proposals and the analysis thereof; and

WHEREAS, the lowest responsible bid was submitted by Half Moon Bay Grading & Paving, Inc., in the amount of One Hundred Seventy-One Thousand Seven Hundred Nineteen and No/100 Dollars ($171,719.00) based on an estimate of the amount of work to be done.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

It is to the best interest of the County of San Mateo to award the contract for the said Project to:

Half Moon Bay Grading & Paving, Inc.

1780 Higgins Canyon Rd.

Half Moon Bay, CA 94019-2522

The County of San Mateo shall enter into a written agreement with Half Moon Bay Grading & Paving, Inc., for the doing of said work as required by the Plans and Specifications therefore adopted and approved by this Board of Supervisors, as hereinbefore mentioned, said Plans and Specifications being on file in the office of the Director of Public Works of the County of San Mateo.

On behalf of the County of San Mateo, the President of this Board of Supervisors shall be, and is hereby, authorized and directed to execute an agreement with Half Moon Bay Grading & Paving, Inc. for the work described herein, subject to the Department of Public Works’ receipt and approval of the Faithful Performance Surety Bond and the Payment Bond required to be posted by said Contractor in connection therewith.

All payments to the Contractor shall be in accordance with the Plans, Specifications, and other contract documents, based on the Director of Public Works' written estimates of work actually done.

Paragraph 4 above notwithstanding, aggregate payments to Contractor shall not exceed the sum of One Hundred Eighty-Eight Thousand Eight Hundred and No/100 Dollars ($188,800.00) without this Board's approval.

6.

The Clerk of the Board of Supervisors, County of San Mateo, is hereby authorized and directed to attest the signature of the President of this Board of Supervisors to said written contract.
