SUBJECT:

Authorization to Extend the Agreement for Provision of Labor Relations Services through December 31, 2010, and to Amend the Agreement to Provide for an Additional Two-Year Extension Option.

 

RECOMMENDATION:

    Adopt a Resolution authorizing the Human Resources Director to:

    1) Extend the agreement with Industrial Employees and Distributors Association (IEDA) for continued provision of labor relations services for two one-year periods from January 1, 2009 through December 31, 2010 and increase contract amount by $312,429 for a maximum obligation of $1,126,429; and;

    2) Amend the agreement to provide an additional two-year option and increase contract amount by $297,165 for a total maximum obligation of $1,423,594.

BACKGROUND:

IEDA has provided labor relations services for the County since 1973. In February 2000, a Request for Information (RFI) was conducted which enabled the Human Resources Department to analyze the services and costs for other labor relations firms in California. IEDA’s rates were lower than any other firm interviewed and their services were more comprehensive.

On October 3, 2000 the San Mateo County Board of Supervisors authorized the President of the Board to execute an agreement with IEDA to provide labor relations and consultation services for the period January 1, 2001 through December 31, 2003, with automatic extensions through December 31, 2005, and compensation to be established at the time of each extension. On November 8, 2005, this agreement was extended from January 1, 2006 through December 31, 2008, increasing the contract amount by $339,000 for a total fiscal obligation of $814,000.

The agreement was also amended to include a clause allowing the County, in its sole discretion, to exercise two one-year options to extend the term of the agreement with IEDA through December 31, 2010.

 

DISCUSSION:

The Human Resources Department is requesting authorization to extend the term of the agreement with IEDA through December 31, 2010, and to amend the agreement to provide the County with the option to extend the agreement by an additional two years through December 31, 2012.

The contract amount will also be increased to cover services incurred during the existing contract term. This increase in cost is due to an increased number of employees in the County workforce and the addition of an AFSCME/SEIU Extra Help Memorandum of Understanding, both of which impact the cost of providing labor relations services. IEDA’s years of experience bargaining in San Mateo County, coupled with its extensive knowledge of and association with other local public sector jurisdictions, are invaluable resources when anticipating and responding to Union proposals.

 

FISCAL IMPACT:

The agreement will be increased from $814,000 to a new maximum fiscal obligation of $1,126,429 for services through December 31, 2010. The total increase of $312,429 represents $35,022 for services incurred during the current contract period as noted above, $136,318 for services provided during January 1, 2009 to December 31, 2009 and $141,089 for services provided during January 1, 2010 to December 31, 2010. Appropriations for this contract have been included in the Adopted FY 2007-08 and Recommended FY 2008-09 Human Resources Department budget.

The costs associated with exercising the second two-year option to extend the agreement total $146,027 for January 1, 2011 to December 31, 2011 and $151,138 for January 1, 2012 to December 31, 2012, for a new maximum fiscal obligation of $1,423,594.
