SUBJECT:

Agreements with the City and County of San Francisco and PALCARE for Child Care Services FY 2008-09 through FY 2012-13

 

RECOMMENDATION:

Adopt a resolution authorizing the President of the Board of Supervisors to:

 

1.

Execute an agreement with the City and County of San Francisco, through the Airport Commission, guaranteeing the County’s receipt of revenue for child care contract services through June 30, 2013, in an amount not to exceed $1,532,500

2.

Execute an agreement with PALCARE to provide the child care services that are funded by the City and County of San Francisco through the Airport Commission, and guaranteeing revenue received from the City and County of San Francisco to pay PALCARE for child care services through June 30, 2013 in an amount not to exceed $1,532,500

3.

Waive the RFP process for selection of PALCARE as a child care contractor

4.

Waive requirement of PALCARE’s compliance with the County’s Jury Service Ordinance

The County’s agreements with the Airport and PALCARE contribute to the goals by collaboratively working together to meet child care needs. PALCARE offers a safe and educational environment to over 200 children ranging in ages 3 months to six years. About 74 children are from airport families and 14 are from County families.

BACKGROUND/DISCUSSION:

Since 1991 the County has had collaborative agreements with the City and County of San Francisco, through its Airport Commission, (“Airport”) and PALCARE for the provision of child care services for Airport employees and the community. Contract requirements imposed by the City/County of San Francisco make contracting directly with PALCARE administratively burdensome for the Airport. In order to facilitate the delivery of child care services, the County has agreed to act as a fiscal intermediary between the Airport and PALCARE. The County benefits from this arrangement as children of County employees receive priority enrollment at PALCARE (behind Airport employees).

 

PALCARE has been designated by the City and County of San Francisco as the child care provider to receive the contract funding. Accordingly, there is no need for a competitive process to select the contractor, and we recommend that your board waive the RFP process on the ground that it is in the County’s best interest to do so.

 

PALCARE, which has a separate long-term operating lease agreement with the County, utilizes a County-owned facility at 945 California Drive in Burlingame that accommodates the child care center.

 

The most recent child care service agreements with the Airport and PALCARE expired on June 30, 2008. The Airport and PALCARE have both notified the County of San Mateo of their interest in entering into new five-year agreements from July 1, 2008 through the end of FY 20012-13. The County’s proposed agreements with the Airport and with PALCARE will enable Airport employees to continue receive subsidized child care services. In addition, the County’s new agreement with PALCARE will continue to include a provision granting children of County employees priority enrollment status at the child care center.

 

PALCARE’s current collective bargaining agreement does not offer pay for jury duty service to employees who live within San Mateo County. The Jury Service Ordinance provides that Contractors who do not comply with the ordinance should submit requests for waivers to the County Manager, and PALCARE has done so. The Ordinance further says that the Board of Supervisors may waive the requirements of this chapter when it determines that it is in the best interests of the County, for reasons such as the contractor’s status as a sole source provider. As PALCARE is the sole source of the child care services specified in the agreement, the County Manager recommends that the Board of Supervisors waive compliance in this instance. The contractor has assured compliance with all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits.

 

FISCAL IMPACT:

The term of both agreements will be from July 1, 2008 through June 30, 2013. The Airport will continue to cover the $306,500 annual payment for PALCARE. There is no Net County Cost to the County for these agreements.
