ADOPT A RESOLUTION AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE A MEMORANDUM OF UNDERSTANDING WITH THE SAN MATEO COUNTY OFFICE OF EDUCATION TO TRANSFER THE ANNUAL SB 3632 ALLOCATIONS TO THE HEALTH DEPARTMENT BEHAVIORAL HEALTH AND RECOVERY SERVICES DIVISION TO PARTIALLY FUND FEDERALLY MANDATED MENTAL HEALTH SERVICES TO SPECIAL EDUCATION STUDENTS, FOR THE TERM JULY 1, 2008 THROUGH JUNE 30, 2011

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, AB 3632 et seq. (Chapter 1747 Statutes of 1984) requires county mental health agencies to provide mental health services to special education students as specified in each student’s Individual Education Plan; and

WHEREAS, the San Mateo County Office of Education will receive Federal Individuals with Disabilities Education Act funding from the State Office of Education and has a legislative requirement to transfer this same funding to the Behavioral Health and Recovery Services (BHRS) Division of the Health Department for the purpose of providing mandated AB 3632 mental health services to special education students; and

WHEREAS, AB 1807 requires that BHRS has a Memorandum of Understanding in place with the San Mateo County Office of Education to allow for the transfer of the Federal Individuals with Disabilities Education Act allocation from the County Office of Education to BHRS for Fiscal Years 2008-11; and

WHEREAS, this Board has been presented with the Memorandum of Understanding for the transfer of the aforementioned Individuals with Disabilities Education Act funding and has examined and approved it as to both form and content and desires to approve the Memorandum of Understanding:

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be and is hereby authorized and directed to execute said Memorandum of Understanding for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.
