Agreement with WRA, Inc. for Final Design and Permitting Services

 

RECOMMENDATION:

Adopt a Resolution:

 

1)

Authorizing the President of the Board to execute an agreement with WRA, Inc., for final design, specifications, and permitting services for a quarter-mile segment of the California Coastal Trail and beach access improvements within Fitzgerald Marine Reserve for the term of July 22, 2008 through July 31, 2009, for a maximum obligation of $174,979 and no Net County Cost; and

   

2)

Authorizing the Director of the Parks Department or Director’s designee, to execute contract amendments which modify the County’s maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.

This agreement contributes to this commitment by providing improved public trail and beach access at the Fitzgerald Marine Reserve for all County residents. This performance measure tracks the number of American with Disabilities Act (ADA) improvements.

BACKGROUND:

The Fitzgerald Marine Reserve Master Plan identified needed improvements to the California Coastal Trail that passes through the Reserve and to improve public access to the reef from the main parking entrance.

 

DISCUSSION:

The proposed quarter-mile-long, multi-use segment of the California Coastal Trail is intended for use by pedestrians, equestrians, and bicyclists, and to comply with the ADA accessibility requirements. The trail would begin at the Reserve’s Visitor Center; extend to the intersection of California Avenue and North Lake Street, cross San Vicente Creek and end at Cypress Street. The trail, as proposed, is a paved 10-foot wide trail with four-foot wide graveled shoulders wherever possible.

 

The existing beach access to the reef located at North Lake Street and Nevada Avenue will be improved to meet ADA requirements to the extent reasonably possible.

 

Through this agreement, the contractor, WRA, Inc., will provide final design and permitting services for these proposed improvements. The term of the agreement is July 22, 2008 through July 31, 2009. The contractor has assured compliance with the County's Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda. A minor modification was made to the hold harmless provision of the County’s standard agreement, as requested by the contractor. The change was reviewed and approved by County Counsel and Risk Management.

County Counsel has reviewed and approved the resolution and agreement, as to form, and Risk Management has reviewed and approved the contractor’s insurance coverage.

 

FISCAL IMPACT:

Project funding has been secured through two grants; a $90,000 grant from the California Coastal Conservancy and a $500,000 grant awarded under Proposition 40. Only a percentage of the grant funding or $215,000 can be used for design, specifications and permitting services. The remaining $375,000 of grant funding will be dedicated to implementation of the project. Funds are assigned in the Parks Department Acquisition and Development Budget. There is no Net County Cost.
