RESOLUTION TERMINATING THE CONTRACT WITH THE LOW BIDDER, C.F. ARCHIBALD PAVING, INC. (CONTRACTOR) AND AUTHORZIING THE DIRECTOR OF PUBLIC WORKS TO REVISE PROJECT PLANS AND SPECIFICATIONS AND RE-ADVERTISE FOR BIDS FOR THE RESURFACING OF BAY ROAD BETWEEN WILLOW STREET AND 2ND AVENUE IN THE NORTH FAIR OAKS AREA

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that
|
|
WHEREAS, this Board of Supervisors did, on June 3, 2008, adopt Resolution No. 069478, which awarded a contract with C.F. Archibald Paving, Inc., for the Resurfacing of Bay Road between Willow Street and 2nd Avenue in the North Fair Oaks Area, which contract was predicated on the receipt of $250,000 in federal funds; and

WHEREAS, the County’s Public Works Department received a memo from Caltrans, dated July 2, 2008, regarding “Federal-Aid Contracts with Disadvantaged Business Enterprise (DBE) Goals,” which stated that awarding federal-aid contracts with DBE goals and/or good faith effort requirements under the current Race Neutral DBE Program renders those projects ineligible for federal reimbursement; and

WHEREAS, Section 8-1.11 of the Caltrans Standard Specifications provides that the Public Works Department reserves the right to terminate the Contract at any time upon a determination by the Director of Public Works that termination of the Contract is in the best interest of the County; and

|
WHEREAS, the Director of Public Works has recommended that the current Contract be terminated and that the Director of Public Works be authorized to revise the Project Plans and Specifications to comply with the current Race Neutral DBE Program for Federal-Aid Contracts so that the federal funds obligated for this project remain reimbursable and re-advertise the Project for bids; and

WHEREAS, this Board has considered and concurs with the recommendation of the Director of Public Works.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:
|

1.

The current Contract with C.F. Archibald Paving Company is terminated as provided by Section 8-1.11 of Caltrans Standard Specifications.
|
|
2.
|
The Director of Public Works is hereby authorized to revise the Project plans and specifications to comply with the current Race Neutral DBE Program guidelines and to re-advertise the Project for bids in August 2008.
|
|
3.
|
The Director of Public Works is authorized and directed to issue a call for sealed proposals to be received by the County Manager/Clerk of the Board of Supervisors, Hall of Justice and Records, 400 County Center (formerly 401 Marshall Street), Redwood City, California, San Mateo County, on or before 2:30 p.m., Tuesday, September 2, 2008, in said office in the Hall of Justice and Records, Redwood City, California. Said bids will then be transmitted to the Board of Supervisors’ Chambers in said Hall of Justice and Records and be publicly opened and declared.
