RECOMMENDATION
|
Acting as the governing board of San Mateo County Service Area No. 8:
|
|
|
|
|
1.

Conduct a public hearing to consider the adoption of the “2008/09 Garbage and Recyclables Collection Charges Report for County Service Area No. 8 (North Fair Oaks).

2.

Adopt a resolution –
|
|
|
|
|
|
a.
|
Approving the 2008/09 Garbage and Recyclables Collection Report for County Service Area No. 8, North Fair Oaks;
|
|
|
|
|
|
b.
|
Directing the filing of the Report with the Clerk of the Board per County Ordinance Code, Chapter 4.04, Section 4.04.220-4.04.270; and
|

|
|
|
|
c.
|
Authorizing the Director of Public Works as appropriate to approve refunds during the fiscal year.

Adopting the 2008/09 Garbage and Recyclables Collection Charges Report will allow the County to collect fees for services for the continued provision of garbage and recycling collection in the North Fair Oaks area.

BACKGROUND

PREVIOUS BOARD ACTION

On May 22, 2007, your Board held a public hearing and adopted Resolution No. 068737 setting the 2007/2008, 2008/2009 Garbage and Recyclables Collection Rates.

On July 22, 2008, your Board adopted a resolution setting August 5, 2008, at 9:15 a.m. in your Board Chambers, as the time and place of a public hearing to consider the adoption of the “2008/09 Garbage and Recyclables Collection Charges Report for County Service Area No. 8 (North Fair Oaks).”

On August 5, 2008, your Board approved the continuation of the public hearing until August 12, 2008.

History
|
CSA-8 provides garbage and recyclables collection service in the North Fair Oaks area through a franchise agreement with Allied Waste Services (AWS). The County generates the revenue to pay AWS by charging fees based on pick-up units for each affected parcel that meets the criteria outlined in County Ordinance Code 4.04.180. These fees are defined and adopted each fiscal year in the “Garbage and Recyclables Collection Service Charges Report for County Service Area No. 8”, and placed on the tax roll. All other commercial and industrial properties that are not placed on the County tax roll are billed directly by AWS.

The current garbage rates were adopted on May 22, 2007, Resolution No. 068737 and have been used to prepare the Collection Charges Report for County Service Area No. 8. A copy of the rate structure is attached as Exhibits A and B.

|
The date, time and location of the public hearing has been published in a newspaper of general circulation in the Service Area once a week for two consecutive weeks prior to the hearing in accordance with County Ordinance Code, Section 4.04.240.

DISCUSSION
|
The adoption of the “2008/09 Garbage and Recyclables Collection Charges Report” and its filing with the Clerk of the Board will result in the user charges contained therein being placed on the tax roll. These charges will appear on the 2008/09 tax bill of each affected property and will be collected in the same manner as the property tax.

Solid Waste collection services provided in the North Fair Oaks area cover costs for residential and commercial garbage/recycling collection, on call bulky waste collection for residents, two times per calendar year, green waste and Christmas tree recycling collection, food waste recycling for commercial customers, electronic waste collection, garbage collection from public cans on Middlefield Road, 5th Avenue and two local parks, landfill fees and all County programs connected with solid waste management and regulatory compliance for the area.

Your Board, after the close of the public hearing, may adopt the individual charges as presented, or revise, change, reduce or modify any charge in the report. The individual garbage/recycling collection service charges were calculated in accordance with the rate structure as stated in County Ordinance Code
Section 4.04.180.

A complete copy of the 2008/09 Garbage and Recyclables Collection Report for County Service Area No. 8, North Fair Oaks is on file and available for review at the Clerk of the Board of Supervisors Office. Occasionally data, data entry, computation, or other errors occur during the annual updating and preparation of this report. Therefore the resolution authorizes the Director of Public Works to refund any overcharges resulting from any such errors in the Report.

A resolution has been approved as to form by County Counsel and a copy of this staff report has been sent to the North Fair Oaks Community Council.
|
|
|
FISCAL IMPACT
|
The minimum charge adopted by the Board and effective as of January 1, 2008 for garbage collection service is $20.93 per month. The individual charges in the service charge report are based upon this rate. There is no impact to the General Fund.
