RESOLUTION MAKING A DETERMINATION OF ZERO PROPERTY TAX EXCHANGE PURSUANT TO THE CALIFORNIA REVENUE AND TAXATION CODE SECTION 99 ET SEQ., FOR ANNEXATION OF SKYLINE FRONTAGE ROAD, BLACK MOUNTAIN ROAD AND GOLF COURSE DRIVE
TO THE TOWN OF HILLSBOROUGH

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that
|
|
WHEREAS, state law requires that the agencies involved in an annexation of territory from one agency to the other agree to a property tax exchange as a result of the proposed annexation; and
|
|
WHEREAS, the San Mateo Local Agency Formation Commission (LAFCO) has received an application for annexation of Skyline Frontage Road, Black Mountain Road, Golf Course Drive and the adjacent land from the Town of Hillsborough for which there is no property tax collected; and
|
|
WHEREAS, the LAFCO Executive Officer is prohibited by law from issuing a certificate of filing for such applications until the agencies determine, pursuant to Section 99 et. seq. of the California Revenue and Taxation Code, the amount of property tax revenues to be exchanged between and among the local agencies whose service areas or service responsibilities will be altered should the annexation occur; and

WHEREAS, it has been determined that there are no property taxes levied against said public roadways and the adjacent land and therefore no property tax revenue will be transferred between the County and the Town of Hillsborough for said roadways and the adjacent land proposed to be annexed by the Town.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that no property tax revenue will be transferred from the County of San Mateo to the Town of Hillsborough for annexation of Skyline Frontage Road, Black Mountain Road, Golf Course Drive and the adjacent land.
