BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION
a. APPROVING THE 2008/09 GARBAGE AND RECYCLABLES COLLECTION REPORT FOR COUNTY SERVICE AREA NO. 8, NORTH FAIR OAKS;
b. DIRECTING THE FILING OF THE REPORT WITH THE CLERK OF THE BOARD PER COUNTY ORDINANCE CODE, CHAPTER 4.04, SECTION 4.04.220-4.04.270; AND
c. AUTHORIZING THE DIRECTOR OF PUBLIC WORKS AS APPROPRIATE TO APPROVE REFUNDS DURING THE FISCAL YEAR.

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, as the governing board of San Mateo County Service Area No. 8, that

 

WHEREAS, the Director of Public Works of San Mateo County has prepared the report described in San Mateo County Ordinance Code Section 4.04.170 et. seq. relating to the collection of garbage and recyclables collection service charges on the tax roll in County Service Area No. 8; and

 

WHEREAS, a public hearing as required by Section 4.04.170 et. seq. of the San Mateo County Ordinance Code was duly held on August 5th and August 12th, 2008, in the Board of Supervisors' Chambers; and

 

WHEREAS, this Board heard and considered all protests and objections to said report, has determined that a majority protest does not exist, and has determined that said rates and charges should be confirmed and adopted as provided by law:

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

 

1.

This Board of Supervisors does hereby confirm and adopt said report and imposes the service charges set forth therein to be, and the same are hereby, established and set for the 2008/09 Fiscal Year.

The Clerk of this Board is directed to record this Resolution with the Recorder of the County of San Mateo, and further, immediately thereafter, to file with the Controller a copy of the report with a statement endorsed thereon that the service charges set forth therein have been adopted by the Board of Supervisors.

 

3.

During the fiscal year the Director of Public Works is authorized to refund, as appropriate, any overcharges contained in said report to the owner of the parcel when the overcharge resulted from data, data entry, computational or other errors associated with the preparation of said report as determined by the Director of Public Works.
