RESOLUTION AWARDING AND AUTHORIZING EXECUTION OF A CONTRACT FOR THE REPAIR OF SANITARY SEWER LINES DAMAGED BY LANDSLIDES IN THE VICINITY OF PARK ROAD AND SPRINGDALE WAY IN THE EMERALD LAKE HILLS AREA, CALIFORNIA, TO CASEY CONSTRUCTION, INC. IN THE AMOUNT OF $271,018.00 (NOT-TO-EXCEED AMOUNT)
(PROJECT NO. SE002, F-351 [25C])

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, acting as the governing board of the Emerald Lake Heights Sewer Maintenance District, that

WHEREAS, this Board of Supervisors did, on July 8, 2008, adopt Resolution No. 069565, which Resolution approved and adopted Plans and Specifications, which Plans and Specifications included the requirement that the contractors performing the work pay not less than the general prevailing rates of wages, and called for sealed proposals for the repair of sanitary sewer lines damaged by landslides in the vicinity of Park Road and Springdale Way in the Emerald Lake Hills Area; and

WHEREAS, the Clerk of this Board of Supervisors did, in public on Tuesday,
July 29, 2008, at 2:30 p.m., open and examine all sealed proposals that were received in the specified time for the doing of the work referred to in said Resolution No. 069565; and

WHEREAS, this Board of Supervisors has caused an analysis of said sealed proposals to be made by the Director of Public Works of the County of San Mateo, and has, in open session, fully reviewed and considered said proposals and the analysis thereof; and

WHEREAS, the lowest responsible bid was submitted by Casey Construction, Inc., in the amount of Two Hundred Forty-Six Thousand Eighteen and 00/100 Dollars ($246,018.00) based on an estimate of the amount of work to be done:

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED

1.

That it is to the best interest of the Emerald Lake Heights Sewer Maintenance District to award the contract for the repair of sanitary sewer lines damaged by landslides in the vicinity of Park Road and Springdale Way in the Emerald Lake Hills Area to:

Casey Construction, Inc.

Emerald Hills, CA 94062

2.

That the County of San Mateo, acting on behalf of the Emerald Lake Heights Sewer Maintenance District, shall enter into a written contract with Casey Construction, Inc. for the doing of said work as required by the Plans and Specifications therefor adopted and approved by this Board of Supervisors, as hereinbefore mentioned, said Plans and Specifications being on file in the office of the Director of Public Works of the County of San Mateo.

That the President of this Board of Supervisors shall be, and is hereby, authorized and directed, for and on behalf of the Emerald Lake Heights Sewer Maintenance District, to enter into said written contract with Casey Construction, Inc. for the doing of said work, as hereinbefore mentioned and to receive and approve the Faithful Performance Surety Bond and the Labor and Material Surety Bond required to be posted by the said Contractor with the County of San Mateo in connection therewith.

That all payments to the Contractor be in accordance with the Plans and Specifications, and other contract documents, based on the Director of Public Works' written estimates of work actually done.

That, Paragraph 4 above notwithstanding, aggregate payments to Contractor shall not exceed the sum of Two Hundred Seventy-One Thousand Eighteen and 00/100 Dollars ($271,018.00) without this Board's approval.

6.

That the Clerk of the Board of Supervisors, County of San Mateo, shall be, and is hereby, authorized and directed to attest the signature of the President of this Board of Supervisors to said written contract.
