SUBJECT:

Agreement, Deed and Exchange of Easements with Costco Wholesale Corporation for the exchange of easements of equal value located in Redwood City.

 

RECOMMENDATION:

Acting as the governing board of the Fair Oaks Sewer Maintenance District, adopt a resolution:

    A) Authorizing and Directing the Board President to Execute the Agreement, Deed and Exchange of Easements with Costco Wholesale Corporation for the exchange of easements of equal value located in Redwood City, and

    B) Authorizing the County Manager or his designee to accept or execute on behalf of the Fair Oaks Sewer Maintenance District, any and all notices, consents, approvals, terminations, deeds, certificates of acceptance, escrow instructions and documents in connection with the Agreement as needed to comply with the intent of this Resolution and the Agreement.

The Agreement contributes to this commitment and goal by authorizing the relocation of sanitary sewer lines and easements to facilitate construction of the new Costco building as approved by the City of Redwood City.

 

BACKGROUND:

Costco Wholesale Corporation owns APNs 053-390-010 (Parcel A) and 053-390-020 (Parcel B) on Middlefield Road in Redwood City. The Fair Oaks Sewer Maintenance District holds two existing easements over Parcel A for a 10” sewer line currently in use and an 8” sewer line that was previously abandoned. The City of Redwood City has approved Costco’s plan to demolish an existing warehouse on Parcel B and build a new warehouse on Parcel A. The new warehouse is to be constructed over a portion of the property that is subject to the easements. Costco proposes to grant a new easement to replace the portion that will be abandoned and relocate the sewer line as needed to facilitate construction of the new building, at no cost to the County. The new line and easement will be over portions of Parcel A and Parcel B.

 

DISCUSSION:

Real Property Services has prepared the Agreement, Deed and Exchange of Easements, which authorizes the District to accept a new easement from Costco and authorizes Costco, at Costco’s own cost, to relocate an existing sanitary sewer line and remove an existing abandoned line. Upon completion of the relocation and the District’s approval of the new sewer line installation, the District will record a quitclaim deed to the portions of the existing easements that will have been replaced by the exchange.

 

County Counsel has reviewed and approved the Amendment as to form. The Director of Public Works concurs in this recommendation.

 

FISCAL IMPACT:

There is no impact to the General Fund.
