Termination and Release of a Subdivision Improvement Agreement with Northpoint Housing, Inc., and Execution of a New Agreement for Subdivision Improvements at the El Camino Transit Village/Trestle Glen Project

 

RECOMMENDATION:

Adopt a Resolution in connection with the El Camino Transit Village/Trestle Glen Project:

 
 

1.

Authorizing Termination and Release of Subdivision Agreement with Northpoint Housing, Inc. dated February 27, 2007 per Resolution No. 068580, contingent on the execution of a new Agreement by and between the County of San Mateo and Trestle Glen Associates.

 
 

2.

Authorizing the President of the Board to Execute a new Subdivision Improvement Agreement with Trestle Glen Associates.

The Subdivision conforms to the requirements of the San Mateo County Subdivision Regulations, and will provide low-and moderate-income housing opportunities.

 

BACKGROUND:

Your Board approved an agreement with Northpoint Housing, Inc. for the Trestle Glen at El Camino Transit Village Subdivision project in January 2007. This agreement required Northpoint Housing, Inc. to construct the necessary improvements along “F” Street between El Camino Real and the Colma BART Station to serve the proposed subdivision.

 

DISCUSSION:

Northpoint Housing, Inc. has transfered the property upon which the project is constructed to Trestle Glen Associates, the developer of the project.

 

Trestle Glen Associates accepts this transfer but has requested that the deadline for completion of the improvements included in the Subdivision Agreement, be extended for two years beyond the original agreement with Northpoint Housing, Inc., through March 1, 2010. Trestle Glen Associates will also be required to obtain an encroachment permit from the Town of Colma because the “F” Street right-of-way is within the Town’s jurisdiction.

 

The agreement for the improvements to be constructed by Trestle Glen Associates shall be secured by a Faithful Performance Bond in the amount of $227,057 to guarantee the performance of the work, and by a Payment Security in the amount of $113,528 to secure payments for labor and materials.

 

The bonds will be released upon satisfactory completion of the improvements and the posting of securities in the amount of fifty percent (50%) of the cost of construction to guarantee the work for one year.

 

Trestle Glen Associates will be required to cover the costs of regular and final inspections provided by the Department of Public Works. A deposit in the amount of $5,000 has already been paid for this purpose, and will be supplemented if necessary.

 

The resolution and agreements have been approved as to form by County Counsel, and the agreements have been executed by Northpoint Housing, Inc. and Trestle Glen Associates.

 

FISCAL IMPACT:

The County has no financial obligation as a result of this agreement.
