BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION IN CONNECTION WITH THE EL CAMINO TRANSIT VILLAGE/TRESTLE GLEN PROJECT:
1. AUTHORIZING TERMINATION AND RELEASE OF SUBDIVISION AGREEMENT WITH NORTHPOINT HOUSING, INC. DATED FEBRUARY 27, 2007 PER RESOLUTION NO. 068580, CONTINGENT ON THE EXECUTION OF A NEW AGREEMENT BY AND BETWEEN THE COUNTY OF SAN MATEO AND TRESTLE GLEN ASSOCIATES.
2. AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE A NEW SUBDIVISION IMPROVEMENT AGREEMENT WITH TRESTLE GLEN ASSOCIATES.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the Board previously authorized execution of an Agreement with Northpoint Housing, Inc., developer of the Trestle Glenn at El Camino Transit Village Project, for construction of off-site improvements to serve the proposed lots in the subdivision and to mitigate for traffic impacts along
“F” Street; and

 

WHEREAS, Northpoint Housing, Inc. has transferred the property upon which the Project is to be constructed to Trestle Glen Associates, a California limited partnership; and

 

WHEREAS, Northpoint Housing, Inc. seeks to be released from its obligations to the County; and

 

WHEREAS, Trestle Glen Associates wishes to enter into an agreement with the County to complete the work that was begun by Northpoint for construction of off-site improvements to serve the proposed lots in the subdivision and to mitigate for traffic impacts along “F” Street; and

 

WHEREAS, performance of the required off-site improvement work to be completed by Trestle Glen Associates has been secured by a Faithful Performance Bond in the amount of $227,057 and a Payment Security Bond in the amount of $113,528 to secure payment for labor and materials and said Bonds have been filed with the Director of Public Works of San Mateo County; and

 

WHEREAS, Trestle Glen Associates will provide an additional security in the amount of $113,528 to guarantee and warranty the work for one year following the completion and acceptance of the on-site improvements; and

 

WHEREAS, an Inspection Deposit has been paid to the Department of Public Works to cover the actual costs incurred by the County for regular and final inspections of the subdivision improvements in accordance with the County of San Mateo Subdivision Regulations; and

 

WHEREAS, this Board has considered the Agreements and the recommendation of the Director of Public Works.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

 

The Board of Supervisors consents to the termination of the Agreement between the County of San Mateo and Northpoint Housing, Inc., contingent on the execution of a new Agreement by and between the County of San Mateo and Trestle Glen Associates.

 

IT IS HEREBY FURTHER ORDERED AND DETERMINED THAT the President of the Board of Supervisors is hereby authorized and directed to Execute a new Agreement by and between the County of San Mateo and Trestle Glen Associates, and the Clerk of this Board shall attest the President’s signature thereto.
