RESOLUTION AWARDING AND AUTHORIZING EXECUTION OF A CONTRACT WITH G. BORTOLLOTO & COMPANY IN THE AMOUNT OF $ 518,500 FOR THE RESURFACING OF BAY ROAD PROJECT IN THE NORTH FAIR OAKS AREA,
FEDERAL PROJECT NUMBER STPL-5935 (041)

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, this Board of Supervisors authorized an application for Federal Surface Transportation Program (STP) funds to partially finance this resurfacing project. The County applied for and was granted funding up to a maximum amount of $250,000 for this project. Caltrans has authorized the County to proceed with the project and has obligated grant funding for this project; and

 

WHEREAS, this Board of Supervisors did, on April 22, 2008, adopt Resolution No. 069380, approving the Plans and Specifications, including conformance with prevailing wage rates scale requirements and calling for sealed proposals for the resurfacing of Bay Road between Willow Street and 2nd Avenue; and

 

WHEREAS, this Board of Supervisor did, on August 5, 2008, adopt Resolution No. 069619, terminating the Contract with the low bidder, C.F. Archibald Paving, Inc. (Contractor) and authorizing the Director of Public Works to revise the Project plans and specifications and re-advertise for bids for the resurfacing of Bay Road between Willow Street and 2nd Avenue in the North Fair Oaks Area; and

 

WHEREAS, the Clerk of this Board of Supervisors did, in public on Tuesday, September 2, 2008, at 2:30 p.m., open and examine all sealed proposals that were received in the specified time for the doing of the work referred to in said Resolution
No. 069619; and

 

WHEREAS, this Board of Supervisors has caused an analysis of said sealed proposals to be made by the Director of Public Works of the County of San Mateo, and has, in open session, fully reviewed and considered said proposals and the analysis thereof; and

 

WHEREAS, the lowest responsible bid was submitted by G. Bortolloto & Company, in the amount of Four Hundred Seventy-One Thousand Three Hundred Twenty-Nine Dollars and Eighty-Three Cents ($ 471,329.83) based on an estimate of the amount of work to be done.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED

 

1.

That it is to the best interest of the County of San Mateo to award the contract for the resurfacing of Bay Road between Willow Street and 2nd Avenue to:

 

G. Bortolloto & Company

San Carlos, CA 94070-6227

   

2.

That the County of San Mateo shall enter into a written contract with G. Bortolloto & Company for the completion of the work as required by the Plans and Specifications adopted and approved by this Board of Supervisors, and on file in the office of the Director of Public Works of the County of San Mateo.

 

3.

That the President of this Board of Supervisors shall be, and is hereby, authorized and directed, for and on behalf of the County of San Mateo, to enter into said written contract with G. Bortolloto & Company for the doing of said work, as hereinbefore mentioned and to receive and approve the Faithful Performance Surety Bond and the Labor and Material Surety Bond required to be posted by the said Contractor with the County of San Mateo in connection therewith.

That all payments to the Contractor be in accordance with the Plans, Specifications, and other contract documents, based on the Director of Public Works' written estimates of work actually done.

 

5.

That, Paragraph 4 above notwithstanding, aggregate payments to Contractor shall not exceed the sum of Five Hundred Eighteen Thousand Five Hundred Dollars ($ 518,500.00) without this Board's approval.

   

6.

That the Clerk of the Board of Supervisors, County of San Mateo, shall be, and is hereby, authorized and directed to attest the signature of the President of this Board of Supervisors to said written contract.
