Resolution Authorizing the Purchase of vacant Assessor’s Parcel 083-140-040, located in the Unincorporated La Honda Area of San Mateo County, from the 1991 Rhodes Family Trust and John Roden and Ellen Roden, for the purpose of making slope stability improvements to the Scenic Drive landslide (C.O.P. 2693)

 

RECOMMENDATION:

    Adopt a Resolution:

 

A)

Authorizing and Directing the Board President to Execute the Agreement with the 1991 Rhodes Family Trust and John Roden and Ellen Roden, for Purchase of Real Property in the Unincorporated La Honda Area of San Mateo County identified as all of Assessor’s Parcel Number 083-140-040, for $3,500.00, and

 

B)

Authorizing the County Manager or his designee to sign escrow instructions and execute any and all notices, consents, approvals, deeds, certificates of acceptance and documents in connection with the purchase of such real property.

Goal(s): Goal 7-- The recommendation is consistent with the shared commitment to ensure basic health and safety for all, and with the goal of making government decisions that maintain and enhance the public safety of all residents and visitors. The acquisition of the property will facilitate the construction of slope stabilization improvements for the La Honda community and Scenic Drive roadway.

 

BACKGROUND:

The County seeks to acquire title to Assessor’s Parcel Number 083-140-040 (the “Property”) from the 1991 Rhodes Family Trust and John Roden and Ellen Roden for the La Honda Landslide Improvement Project ("Project"). Pursuant to the Project plan, slope stabilization remedial measures include the construction of a subsurface drain in the lower Scenic Drive right of way. In order to construct the improvements, it is necessary to excavate portions of the neighboring parcels, several of which were obtained by the County following previous landslides. To complete the excavation and subdrain installation, the County must obtain the necessary property rights, and the owners of this parcel have advised that they would prefer to convey title to the property rather than to convey limited property rights. This property is essential to the repairs, as it is adjacent to the roadway.

 

On October 30, 2007, this Board adopted Resolution No. 69071 authorizing the Department of Public Works to proceed with preparations for the construction of recommended slope stabilization improvements in the vicinity of Scenic Drive in La Honda such that the work could be underway at the earliest opportunity.

 

On February 12, 2008, this Board adopted Resolution No. 69258 declaring its intention to authorize work on the improvements. An assessment district to finance the improvements was created in April 2008.

 

DISCUSSION:

Real Property Services has negotiated an Agreement for Purchase of Real Property with the owners of the Property for $3,500.00.The County will be responsible for any title insurance and escrow fees. The Agreement requires that Escrow close on or before September 30, 2008.

 

County Counsel has reviewed and approved the Agreement as to form. The Director of Public Works concurs in this recommendation.

 

FISCAL IMPACT:

The Project is funded by multiple sources including the General Fund, an Assessment District and a State grant. The cost of acquiring necessary property rights is in the approved Project budget.
