RESOLUTION ENDORSING THE PROVISIONS OF THE AGREEMENT BETWEEN THE SOUTH BAYSIDE WASTE MANAGEMENT AUTHORITY (SBWMA) AND THE CITY OF SAN CARLOS WHICH AUTHORIZES PAYMENT OF 5% OF THE GATE FEES TO THE CITY OF SAN CARLOS IN CONSIDERATION OF SERVICES IT PROVIDES IN ITS CAPACITY AS HOST CITY OF THE REGIONAL SHOREWAY RECYCLING AND DISPOSAL CENTER (SRDC)

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the County became a member of the SBWMA in 1982, which is a Joint Powers Agreement comprised of 12 jurisdictions: Atherton, Belmont, Burlingame, East Palo Alto, Foster City, Hillsborough, Menlo Park, Redwood City, San Carlos, the City of San Mateo, the County of San Mateo, and the West Bay Sanitary District; and

WHEREAS, the SBWMA owns a transfer station and materials recovery facility located in the City of San Carlos (City) known as the Shoreway Recycling and Disposal Center (the SRDC Facility); and

WHERAS, the SBWMA’s Joint Exercise of Powers Agreement contemplates that the SBWMA and the City will agree upon the amount of a franchise fee that the city will receive from the operation of the SRDC Facility in order to offset impacts to the City that occur as a result of the Facility being located in San Carlos; and

WHEREAS, the SBWMA and City have entered into an Agreement setting forth the terms and conditions on which a franchise fee will be paid to City; and

WHEREAS, the SBWMA Executive Director requests Members of the JPA to endorse the Agreement, and particularly those provisions which authorize the payment of 5% of the gate fees to the City of San Carlos in consideration of services it provides in its capacity as host city of the regional facility; and

WHEREAS, the SBWMA Board of Directors approved the Agreement on
July 24, 2008.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors of the County of San Mateo, State of California hereby endorses the provisions of the agreement between the SBWMA and the City of San Carlos which authorizes payment of 5% of the gate fees to the City of San Carlos in consideration of services it provides in its capacity as host city of the regional Shoreway Recycling and Disposal Center.
