Agreement with the City of Hayward
 

RECOMMENDATION:

Adopt a Resolution:

1.

Authorizing the President of the Board to execute an Agreement with the City of Hayward whereby the Sheriff's Office Forensic Laboratory will provide forensic laboratory services for a three year term (July 1, 2008 through June 30, 2011), in exchange for the City’s payment to the County of a maximum of $120,000; and

2.

Authorizing the Sheriff to execute contract amendments which modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.

BACKGROUND:

During the past fiscal year the San Mateo County Sheriff’s Office Forensic Laboratory has provided forensic services to the City of Hayward, under a short term contract. The City is now requesting to continue this relationship for an additional three years. The contract, which is similar to the ones presently in place with the City of Vallejo, and Concord have worked very well with little impact to the cities within San Mateo County. Hayward will continue to be responsible for transporting all evidence to be examined to the San Mateo County Sheriff’s Forensic Laboratory.

 

DISCUSSION:

The Hayward Police Department has requested the San Mateo County Sheriff's Office to provide supplemental forensic services, as the San Mateo County Lab is professionally certified and accredited, and offers a competitive hourly rate in comparison to other options.

The proposed three (3) year agreement will allow the Sheriff's Office Forensic Lab to provide 250 hours of annual forensic services to the City of Hayward. The Sheriff’s Forensic Lab will perform all services in the laboratory, and provide expert testimony in court when requested. Therefore, the service provided to the City of Hayward will not compromise the timeliness or the quality of services provided to law enforcement agencies in the County of San Mateo.

If approved, San Mateo County will be one of two laboratories providing Forensic Services to the City of Hayward.

County Counsel has reviewed and approved the resolution and agreement as to legal form.

 

FISCAL IMPACT:

The County will receive a maximum of $120,000 for the services being provided over the three year term of the agreement. Yearly payments of $40,000 are based on the projection of the number of hours of service that the City will require, multiplied by an hourly rate of $160.00. Subsequent years payments will be adjusted based on the actual number of hours of service provided in the previous year. Revenue generated will be used to offset the Sheriff’s Office Forensic Laboratory’s staff, supplies and services needed to provide the services to the City of Hayward. The revenue from this agreement will be included in the Sheriff’s Office Proposed FY 2008-09 Budget.
