RESOLUTION (1) CONSOLIDATING THE PRESIDENTIAL GENERAL ELECTION, TO BE HELD ON TUESDAY, NOVEMBER 4, 2008, WITH ELECTIONS CALLED BY THE COUNTY OF SAN MATEO, BAYSHORE ELEMENTARY SCHOOL DISTRICT, BELMONT-REDWOOD SHORES ELEMENTARY SCHOOL DISTRICT, CABRILLO UNIFIED SCHOOL DISTRICT, MILLBRAE ELEMENTARY SCHOOL DISTRICT, PACIFICA SCHOOL DISTRICT, RAVENSWOOD CITY SCHOOL DISTRICT, SAN CARLOS SCHOOL DISTRICT, SAN MATEO COUNTY BOARD OF EDUCATION, SOUTH SAN FRANCISCO UNIFIED SCHOOL DISTRICT, SEQUOIA HEALTHCARE DISTRICT, MIDPENINSULA REGIONAL OPEN SPACE DISTRICT, TOWN OF ATHERTON, CITY OF BRISBANE, TOWN OF COLMA, CITY OF DALY CITY, CITY OF EAST PALO ALTO, CITY OF MENLO PARK, CITY OF PACIFICA, AND CITY OF REDWOOD CITY; AND (2) AUTHORIZING THE CHIEF ELECTIONS OFFICER TO RENDER SPECIFIED ELECTION SERVICES IN CONJUNCTION THEREWITH

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, pursuant to state law, the County’s Chief Elections Officer has called and shall conduct a regularly scheduled Presidential General Election throughout San Mateo County on Tuesday, November 4, 2008; and

 

WHEREAS, California Elections Code sections 10400-10418 authorize the consolidation of elections that are called to be held on the same day in or within the same territory, upon the order of the governing body or bodies calling the elections, and provide that, where one of the elections is a statewide election, the consolidation may be ordered by the county Board of Supervisors upon request, and the consolidated election shall be held in all respects as if it were one election, and the returns shall be canvassed by the County elections official; and

 

WHEREAS, pursuant to state law, the Board of Supervisors of the County of San Mateo adopted Resolution No. 069609 and Resolution No. 069610 calling an election on Tuesday, November 4, 2008, for the purpose of submitting ordinance adoption measures to the County’s voters; and

 

WHEREAS, the Cabrillo Unified School District, Pacifica School District, Ravenswood City School District, San Mateo County Board of Education, and South San Francisco Unified School District are required to hold regularly scheduled governing board elections on Tuesday, November 4, 2008, and the named districts have notified the County Elections Official of the number of seats to be elected and the relevant policies for breaking a tie vote, have provided conflict of interest filings for candidates, and more candidates have filed than there are seats available; and

 

    WHEREAS, pursuant to state law, the Sequoia Healthcare District adopted Resolution No. 08-2 giving notice of holding a governing board election on Tuesday, November 4, 2008, for the purpose of electing two directors for terms of four years, and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefor, and a service agreement has been executed; and

 

    WHEREAS, pursuant to state law, the Midpeninsula Regional Open Space District adopted Resolution No. 08-27 giving notice of holding a regularly scheduled governing board election on Tuesday, November 4, 2008, for the purpose of electing one member for a term of four years, and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefor, and a service agreement has been executed; and

 

WHEREAS, pursuant to state law, the governing body of the Bayshore Elementary School District adopted Resolution No. 23-0708 giving notice of holding a special election on Tuesday, November 4, 2008, for the purpose of submitting a special tax measure to District voters and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefor, and a service agreement will be executed; and

 

WHEREAS, pursuant to state law, the governing body of the Belmont-Redwood Shores Elementary School District adopted Resolution No. 1 giving notice of holding a special election on Tuesday, November 4, 2008, for the purpose of submitting a parcel tax measure to the District’s voters and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefor, and a service agreement will be executed; and

 

WHEREAS, pursuant to state law, the governing body of the Millbrae Elementary School District adopted Resolution No. 08-09-01 giving notice of holding special election on Tuesday, November 4, 2008, for the purpose of submitting a bond measure to the District’s voters and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefor, and a service agreement will be executed; and

 

WHEREAS, pursuant to state law, the Board of Directors of the San Carlos School District adopted Resolution No. 01:08/09 giving notice of holding a special election on Tuesday, November 4, 2008, for the purpose of submitting a parcel tax measure to the District’s voters and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefor, and a service agreement will be executed; and

 

WHEREAS, pursuant to state law, the City Council of the Town of Atherton adopted Resolution No. 08-19 giving notice of holding a regularly scheduled general municipal election on Tuesday, November 4, 2008, for the purpose of electing two council members for a term of four years and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefor, and a service agreement has been executed; and

 

    WHEREAS, pursuant to state law, the City Council of the City of Brisbane adopted Resolution No. 2008-28 giving notice of holding a special election on Tuesday, November 4, 2008, for the purpose of submitting a business license tax measure to the City’s voters and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefor, and a service agreement has been executed; and

 

    WHEREAS, pursuant to state law, the Town Council of the Town of Colma adopted Resolution No. 2008-40 giving notice of holding a regularly scheduled general municipal election on Tuesday, November 4, 2008, for the purpose of electing three members to the council for terms of four years, and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefor, and a service agreement has been executed; and

 

    WHEREAS, pursuant to state law, the City Council of the City of Daly City adopted Resolution No. 08-72 giving notice of holding a regularly scheduled general municipal election on Tuesday, November 4, 2008, for the purpose of electing two members to the council for terms of four years, and one city clerk for a term of four years, and one city treasurer for a term of four years, and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefor, and a service agreement has been executed; and

 

    WHEREAS, pursuant to state law, the City Council of the City of East Palo Alto adopted Resolution No. 2797 giving notice of holding a regularly scheduled general municipal election on Tuesday, November 4, 2008, for the purpose of electing three members to the council for terms of four years and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefor, and a service agreement has been executed; and

 

    WHEREAS, pursuant to state law, the City Council of the City of Menlo Park adopted Resolution No. 5811 giving notice of holding a regularly scheduled general municipal election on Tuesday, November 4, 2008, for the purpose of electing two members to the council for terms of four years and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefor, and a service agreement has been executed; and

 

    WHEREAS, pursuant to state law, the City Council of the City of Pacifica adopted Resolution No. 36-2008 giving notice of holding a regularly scheduled general municipal election on Tuesday, November 4, 2008, for the purpose of electing two members to the council for terms of four years, and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefor; and a service agreement has been executed; and

 

    WHEREAS, pursuant to state law, the City Council of the City of Redwood City adopted Resolution No. 14882 and Resolution No. 14883 giving notice of holding a special election on Tuesday, November 4, 2008, for the purpose of submitting charter amendment measures to the City’s voters and requesting the Board of Supervisors to permit the Chief Elections Officer to render specified election services therefor, and a service agreement has been executed; and

 

    WHEREAS, the County’s Chief Elections Officer is agreeable to providing specified election services as duly requested and enumerated above, in conjunction with the Presidential General Election to be held on Tuesday, November 4, 2008; and

 

    WHEREAS, in consideration of the services and supplies to be provided by the Chief Elections Officer, the above named municipalities and districts shall reimburse to the County for all costs subject to reimbursement

 

    NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that (1) the statewide November 4, 2008 Presidential General Election is hereby consolidated with the above named local elections duly called by their governing bodies; and (2) the Chief Elections Officer is hereby authorized to render specified election services in conjunction therewith.
