Annexation of Property to the Oak Knoll Sewer Maintenance District - Lands of Cool (711 Esther Lane, APN 058-245-020, 058-244-030, 093-500-050 and a Portion of 093-501-010) – Redwood City (Oak Knoll) Area

 

RECOMMENDATION:

Acting as the governing board of the Oak Knoll Sewer Maintenance District (District), adopt a resolution setting a time and place (October 28th, 2008 at 9:00am – Board Chambers, 400 County Center) for a public hearing to consider the proposed annexation of the Lands of Cool to the Oak Knoll Sewer Maintenance District
(711 Esther Ln, APN 058-245-020, 058-244-030, 093-500-050 and a portion of
093-501-010) – Redwood City (Oak Knoll) Area.

Your Board authorizing a public hearing to consider the proposed annexation can result in providing effective sanitary sewer service to a parcel in a suburban area that would otherwise use an “on-site” method to handle wastewater, which could have an impact on neighboring residents.

 

BACKGROUND:

 

Previous Board Action

Entered into an agreement with the City of Redwood City dated August 23, 1983, which provides for the transmission and disposal through City facilities, of wastewater collected in the District.

 

History

The City/District Agreement requires properties that are proposed to be served by the District to be annexed to the District, and also requires the City to approve said annexations into the District. The City executed Resolution 14889 on August 25, 2008 consenting to the proposed annexation of this property. A public hearing to consider an annexation to the District is required pursuant to Section 4860 et seq. of the Health & Safety Code.

 

DISCUSSION:

Dolly Cool is the current owner of the property at 711 Esther Lane, which is also identified as Assessor’s Parcel Number 058-245-020, 058-244-030, 093-500-050 and a portion of 093-501-010. The property owner has requested that the property be annexed to the District in order to receive sewer service.

 

Public Works staff has determined that the property can be served through the facilities of the District, and recommends that a public hearing be set for the Board’s regular meeting of October 28th, 2008, at 9:00 a.m., to consider the proposed annexation.

 

The resolution has been approved as to form by County Counsel, and the required notices will be posted and published subject to the Board adopting the proposed resolution.

If the annexation is approved and sewer service provided, the property owner will be subject to the annual sewer service charge levied by the District, currently $600 per year; will also be required to reimburse “down stream” property owners for a proportionate share of the sewer main that they had previously constructed and which will be used to transport waste water from this property; and to construct and pay for the sewer main extension and sewer lateral that is necessary to bring sewer service to this property.

 

There is no impact to the County’s General Fund.
