RESOLUTION AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE AGREEMENTS WITH BARRY MCNAMARA, M.D. AND JOHN MCNAMARA, M.D. FOR OPHTHALMOLOGY SERVICES FOR THE TERM SEPTEMBER 1, 2008 THROUGH AUGUST 31, 2011, IN AN AMOUNT NOT TO EXCEED $509,400 COLLECTIVELY, FOR THE TWO AGREEMENTS AND 2) AUTHORIZING THE CHIEF EXECUTIVE OFFICER OR DESIGNEE TO EXECUTE CONTRACT AMENDMENTS WHICH MODIFY THE COUNTY’S MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $25,000 (IN AGGREGATE) FOR EACH AGAREEMENT ($50,000 IN AGGREGATE TOTAL BETWEEN THE TWO AGREEMENTS), AND/OR MODIFY THE CONTRACT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICES IS/ARE WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, San Mateo Medical Center (SMMC) has engaged in extensive negotiations for ophthalmology services for the past year which resulted in a collective contract with three providers, two of which are addressed by this Resolution; and

 

WHEREAS, SMMC wishes to enter into separate Agreements with Doctors Barry McNamara and John McNamara to provide ophthalmology services for the period September 1, 2008 through August 31, 2011, for a maximum amount not to exceed $254,700 for each Agreement, or $509,400 collectively; and

 

WHEREAS there has been presented to this Board of Supervisors for its consideration and acceptance two Agreements, reference to which is hereby made, whereby Doctors Barry McNamara and John McNamara shall provide professional ophthalmology services at an increased level of service and productivity;

WHEREAS, this Board has been presented with a form of each Agreement and has examined and approved them as to both form and content and desires to enter into the Agreement:

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby authorized and directed to execute said Agreements for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signature thereto.

 

BE IT FURTHER RESOLVED that the Chief Executive Officer of SMMC or designee shall be authorized to execute contract amendments which modify the County’s maximum fiscal obligation by no more than $25,000 (in aggregate) for each Agreement (for a total of $50,000 in aggregate between the two Agreements), and/or modify each contract’s term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
