SUBJECT:

Interagency Agreement between the County of San Mateo and the San Mateo County In-Home Supportive Services, Public Authority

 

RECOMMENDATION:

1.

Adopt a Resolution:

a.

Authorizing the President of the Board to execute an Interagency Agreement between the County of San Mateo and San Mateo County In-Home Supportive Services Public Authority for the independent provider component of the In-Home Supportive Services Program for FYs 2008-2011; and

b.

Authorizing the County Manager to execute a Business Associate Agreement between the County of San Mateo and the County of San Mateo In-Home Supportive Services Public Authority for FYs 2008-2011.

2.

Adopt a Resolution, as the Governing Board of the In-Home Supportive Services Public Authority authorizing execution of an Interagency Agreement between the San Mateo County Public Authority and the County of San Mateo for FYs 2008-2011.

These agreements contribute to this commitment and goal through the continuation of the independent provider component of the In-Home Supportive Services (IHSS) Program.

 
 

Aging and Adult Services (AAS) has continued to make the provision of services which help maintain at-risk individuals in a least restrictive setting a division-wide performance measure. With the assistance of the services provided through these agreements, AAS has met this measure as a division.

BACKGROUND:

In September 1993 by ordinance of the San Mateo County Board of Supervisors, a separate Public Authority was established to administer the provider components of the IHSS Program. The enabling ordinance designated the Board of Supervisors as the Governing Board of the IHSS Public Authority.

 

IHSS Public Authority regulations require that the County and the Public Authority have an Interagency Agreement. That Agreement must specify the purpose, scope or nature of the arrangement, roles and responsibilities of each party, provisions ensuring compliance with all applicable State and Federal laws and regulations, and fiscal provisions under which the Public Authority will be reimbursed.

 

DISCUSSION:

The proposed Interagency Agreement meets the regulatory requirements and reflects the relationship that exists between the County and the IHSS Public Authority. Approval of the Interagency Agreement, which includes the County-required HIPAA Business Associate language, will enable the IHSS Public Authority to receive reimbursement for State and Federal shares of the IHSS Public Authority expenses.

 

County Counsel has reviewed and approved the two Resolutions and the Interagency Agreement as to form and content.

 

FISCAL IMPACT:

The term of this Interagency Agreement is July 1, 2008 through June 30, 2011. Annual costs for administration of IHSS Public Authority (exclusive of services) are budgeted at $999,486 for 2008-09 and $1,020,059 for 2009-10. Based on past history, reimbursements for administrative costs of the IHSS Public Authority will be $344,801 in State funds and $461,057 in Federal funds in 2008-09, leaving a County share of $193,628. Projected reimbursements in 2009-10 are $350,106 from the State and $468,150 in Federal revenues, leaving a County share of $201,803. These costs and revenues are included in the IHSS Public Authority FY 2008-09 and 2009-10 Adopted Budgets.

 

There will be no additional Net County Cost as a result of the approval of this Interagency Agreement. Funding for the third year, 2010-11, will be brought before your Board for approval.
