Amendment to the Agreement with PSC Environmental Services

 

RECOMMENDATION:

Adopt a Resolution authorizing the President of the Board to execute an Amendment to the Agreement with PSC Environmental Services to process and dispose of hazardous waste, extending the term of the agreement from November 30, 2008 to May 31, 2009, and increasing the total amount by $225,000, for a new maximum obligation of $2,381,000.

The Agreement with PSC Environmental Services (PSC) contributes to this commitment and goal by ensuring that household hazardous waste does not pose a health and safety danger to residents or cause environmental damage through improper disposal onto lands or waterways.

BACKGROUND:

The Environmental Health Division (EHD) operates a Household Hazardous Waste (HHW) Program that collects and safely processes HHW from residents. On January 31, 2006, your Board approved an Agreement with PSC to process and dispose of household hazardous waste for the term of December 1, 2005 through November 30, 2008, for $1,606,000.

 

Subsequently, on July 24, 2007, your Board approved an Amendment to the Agreement with PSC to add $550,000, for a new total of $2,156,000.

 

DISCUSSION:

The State Department of Toxic Substance Control continues to designate new items that are required to be managed as hazardous waste, increasing the amount of HHW that needs to be collected. In San Mateo County, the number of homes served has increased from 800 in 2007, to over 1,100 per month and the annual amount of HHW collected has grown from 230 tons to more than 550 tons.

 

The higher demand for HHW services has resulted in an increase in the workload of staff. EHD needs additional time to develop a comprehensive Request for Proposals for continued HHW services. In the interim, it is necessary to ask for an extension to the current contract with PSC. We are requesting to extend the term of the contract with PSC from November 30, 2008 to May 31, 2009, and to increase the amount of the Agreement by $225,000 to pay for expenses incurred during the extended period.

 

The County Manager has approved extending the contract with PSC beyond three years. The Agreement has been reviewed by County Counsel and Risk Management. The contractor has assured compliance with the County's Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits.

 

FISCAL IMPACT:

The term of the Agreement is December 1, 2005 through November 30, 2008. This Amendment extends the term of the Agreement through May 31, 2009. The original amount of the Agreement was $1,606,000. Amendment One added $550,000 and increased the maximum obligation to $2,156,000. Amendment Two adds $225,000, bringing the total maximum obligation to $2,381,000. Funding in the amount of $505,000 is included in the Environmental Health FY 2008-09 Adopted Budget. There is no increase in Net County Cost as a result of this Amendment.
